Missouri House Proposes Jail Time for Feds Violating the 2nd Amendment

Missouri conservatives proposed a bill that will punish feds violating the Second Amendment with jail time.
The Tenth Amendment Center reported:

Introduced by Missouri State Representative Casey Guernsey, with 61 co-sponsors, is the Missouri 2nd Amendment Preservation Act. House Bill 170 (HB170) would nullify any and all federal acts, orders, laws, statutes, rules, or regulations of the federal government on personal firearms, firearm accessories, and ammunition.

The bill states, in part:

“Any official, agent, or employee of the federal government who enforces or attempts to enforce any act, order, law, statute, rule, or regulation of the federal government upon a personal firearm, a firearm accessory, or ammunition that is owned or manufactured commercially or privately in the state of Missouri and that remains exclusively within the borders of the state of Missouri shall be guilty of a class D felony.”

A class D felony in Missouri carries a prison sentence of up to 4 years.

While a number of states, including Wyoming, South Carolina, Indiana, and others – are looking to go head to head with the feds on specific issues under the 2nd amendment, the Missouri legislation is the strongest introduced anywhere in the country so far.

Impeach Obama before he destroys our Constitution and the freedoms that many have died to protect!!!!!!!

  • NeoKong

    I love it.
Can they attach a rider to it that includes judges who violate their oath to uphold the Constitution and the rule of law…?

  • mg4us

This is a good first step but States need to reign in Washington DC’s out of control reckless behavior, rules and spending. . .

And when we do lock Fed folks up in State Prisons, remember to give them this advice. .
NEVER DROP YOUR BAR OF SOAP IN THE SHOWER

(Although from what I have heard, Obama might like it!) Rahm Emanuel too. .

do you folks understand what is going on here? (and Texas too, any more wanna join in?)

How ironic. Obama is on the Bull Connor side of this issue and he is too stupid to know it.

I say the hell with rallies, calls, emails, letters and door-to-door campaigns-
let’s get on with the inevitable

why do you think they’ve made their move for guns now?
(after how many years of saying they gave up the push?)
because they want the Patriotic Citizenry disarmed before they collapse the economy, crash the system and invite armies onto our soil for the total takedown

the only questions are when and how

“The very purpose of a Bill of Rights was to withdraw certain subjects from the vicissitudes of political controversy, to place them beyond the reach of majorities and officials, and to establish them as legal principles to be applied by the courts. One’s right to life, liberty, and property, to free speech, a free press, freedom of worship and assembly, and other fundamental rights may not be submitted to vote; they depend on the outcome of no elections.”

So, when Airforce #1 lands in that State, will there be a running gun battle between State Law Enforcement Officers trying to arrest Barack for violation of State Law and Obama’s Secret Service guys? One can only hope!

Contact your state legislators to express your support for HB 170 and SB 150, the counterpart bill in the state senate. Others worthy of action are HB 162 (Missouri Firearms Freedom Act) and HCR 6, which reasserts Missouri sovereignty under the Tenth Amendment.

How about a background check on Obama? WAAAAYYY past due!

There’s an awful lot of chest-thumping and posturing going on here this evening. For all the talk of insurrection, Second Amendment remedies, etc. are any of you really planning to use your guns, or are you just hopping someone else will use theirs to make spice life up a bit? Methinks the gentlemen protest too much and I’d be willing to place a bet…

With all the “power, and damage he’s done with that power” seems pretty elementary that one would have done a background check on the Bamster……but, nooooooo!

What did the founders have to say about responsibility and accountability? I don’t remember that they said the citizens were exempt from being responsible and being accountable for their guns.

“I really, really hope this president and his authoritarian cohorts in Congress will slow down, take a deep breath and realize that, right now, they’re playing a very dangerous game of chicken.

If they try what I think they might, but hope they don’t, I fear this nation – already on the precipice of widespread civil unrest and economic disaster – might finally spiral into to utter chaos, into a second civil war.

But then again, that may be exactly what they have in mind.”

if they do impeach 0bama… make sure the court sends him to gitmo… to be waterboarded along with his michelle

hahaha… the outrage by the left would be so massive… it would be hilarious

Just maybe if the feds enforced the thousands of laws on the books already, stop letting violent criminals back out, stopped ATF from arming Mexican drug gangs, and enforced our emigration laws, Americans might be just a little safer in their homes. But then that would be counter productive with the Democrat entitlement whore voter.
Notice how the lib night crawlers will not even attempt to defend the failed the failed gun laws in places like Chicago. Their solution more laws, but then if I was a closet Socialist I’d be afraid of armed Americans also.

#28 Sasja……just what I wanted to know. I went off on her on another thread because of her stupid liberal talk of responsibility. She seems to be blind to the fact that liberals have created these mass shootings.

How? They built their villages. They have fought to take God out of everything because that offends. They have fought against American traditions because that might offend someone. They did not like the old America. SO THEY CREATED THIS NIGHTMARE. The mentally ill sleep on the streets instead of hospitals. They do not even see terrorists. They NEVER say a word about the ugly music, movies and games. Never. They built it.

Blood is on the liberals hands. That simple. Now they preach responsibility for what they created. Do they think that any conservative would have allowed all I just ranted about?

They kill unborn babies but do they publish a murderers list? Nope. They publish the names of legal gun owners. They write another law and turn their blind eyes from all those laws they have on the books while Chicago has been killing their kids for years.

Responsibility, doncha know? Yep. It’s those village builders at it again.

  • Earthmover

Owl, the liberals say the GOP dont care about the children yet they murder a million
babies a year before they are born. it’s incredible. Good thing they dont reproduce.
    eventually they will die off.

    Ahem! Cough! cough!

Sorry, Missouri Legislature and readers here, but, you can’t do that!

You elected Claire McCaskill, you need to get her approval first. She works for Dictator hussein soetoro, not you. So, you’re beholden to obey the commie scum dictator.

You guys are the “Show Me” state, and dirt-bag Claire McCaskill is gonna show you the way to the gun confiscation centers.

I hope to see Lincoln’s wife face when she meet face to face with GOD the Creator who created her. That would be priceless. I would allow you to rant cause I already understand what you have done similar the last time they [trolls paid by government which is possible ignore any logical question with evidence shown] wanted to stir up trouble at the thread.

  • Lim Lynn

*when I had intense debate with them the last time trolls wanted to stir up trouble that cause me to take a big break from this blog.

  • SkippingDog

You’d think they would be familiar with the Supremacy Clause of our Constitution, even in the hellhole of Missouri.

  • DENNIS

Obama’s buddy, Governor Jay Nixon, will never sign the bill into law, and the legislature doesn’t have the votes to override a veto. I do, however, applaud the effort. The states need to stand up and tell the feds to back off.

  • GoMO

Perhaps they are shooting for nullification there skippingdog. Ok so it hasn’t worked in the past but when you tamper with a constitutional issue by using federal law then place sole judgement of that “federal” law with “federal” judges how do you think that one is gonna come out…. You’ve got an issue that has the potential to cause a lot of unrest and for good cause. The federal government is I think rightly seen as out of touch and attempts to influence local/state environments by far removed rule don’t seem to have a good outcome in this union.
