Hah! Obamacare Provision Forbids Democrats From Restricting Guns and Ammo

Pelosi told us they had to ram through the Obamacare monstrosity so that you can find out what’s in it.

Well, now we know what’s in it…
Harry Reid slipped a provision in the Obamacare law that forbids Democrats and the White House from restricting guns and ammo.
Forbes reported:

As for Reid’s reasons for burying a pro-gun measure into the body of the Affordable Care Act, the Majority Leader is said to have been concerned that the NRA planned to take an active position against the passage of Obamacare and decided, no doubt with the permission of Reid’s friend, NRA boss Wayne LaPierre, to head the problem off at the pass by putting language in the bill that would mollify the gun lobby.

Further, there was concern that a conspiracy theory then in circulation among right-wing circles—a meme suggesting that the Obama Administration had cleverly planted language in the ACA that could be used as a tool to get to the guns—would further erode public support for the legislation. For these reasons, Reid determined to insert some cozy language for the gun people into the Senate version of the ACA—language certain to escape public review at a time when the conversation was far more focused on hot button subjects like death panels, taxes and mandates.

For these reasons, the following language did, indeed, become a part of the nation’s controversial health care reform law:


‘‘(1) WELLNESS AND PREVENTION PROGRAMS.— A wellness and health promotion activity implemented under subsection (a)(1)(D) may not require the disclosure or collection of any information relating to—

‘‘(A) the presence or storage of a lawfully- possessed firearm or ammunition in the residence or on the property of an individual; or

‘‘(B) the lawful use, possession, or storage of a firearm or ammunition by an individual.

(2) LIMITATION ON DATA COLLECTION.—None of the authorities provided to the Secretary under the Patient Protection and Affordable Care Act or an amendment made by that Act shall be construed to authorize or may be used for the collection of any in- formation relating to—

‘‘(A) the lawful ownership or possession of a firearm or ammunition;

‘‘(B) the lawful use of a firearm or ammunition; or

‘‘(C) the lawful storage of a firearm or ammunition.

‘‘(3) LIMITATION ON DATABASES OR DATA BANKS.—None of the authorities provided to the Secretary under the Patient Protection and Affordable Care Act or an amendment made by that Act shall be construed to authorize or may be used to maintain records of individual ownership or possession of a firearm or ammunition.

So, the question is… What isn’t in the Obamacare law? This may be a win for gun owners but it also shows the depth of corruption in the Democratic Party.

    There is corruption on the other side of the aisle as well which is why we are in such a mess. If each and every one of our elected officials would honor their oath of office, we would not find ourselves in a battle for the preservation of this Republic.

    (Sec. 1303, as modified by Sec. 10104) Sets forth special rules for abortion coverage, including: (1) permitting states to elect to prohibit abortion coverage in qualified health plans offered through an Exchange in the state; (2) prohibiting federal funds from being used for abortion services; and (3) requiring separate accounts for payments for such services. PROHIBITS ANY QUALIFIED HEALTH PLAN OFFERED THROUGH AN EXCHANGE FROM DISCRIMINATING AGAINST ANY INDIVIDUAL HEALTH CARE PROVIDER OR HEALTH CARE FACILITY BECAUSE OF ITS UNWILLINGNESS TO PROVIDE, PAY FOR, PROVIDE COVERAGE OF, OR REFER FOR ABORTIONS.


  • Easily fixed by the arrogant Dems in Washington. Simply make it illegal for anyone to possess a firearm while undergoing medical treatment, and *poof*. All of those restrictions blow away like dust.

    Never underestimate the stupidity of people in large groups, particularly when the group size is evenly divided by 535 or so.

    [So, the good news for the gun folks is that the ACA is, indeed, prevented from being used as a weapon in the ‘War on Guns’ under the guise that guns are bad for people’s health. They can also take solace in the fact that the law prevents government from collecting any gun data resulting from information obtained in the course of medical providers doing their thing—much as HIPAA prevents such information from being used for a variety of purposes.

    Beyond that, if you imagine that this obscure section of the Affordable Care Act is going to block the Administration from exercising whatever legal authority it may have to regulate guns in America, I’m afraid you will be quite disappointed.

    I think all would agree that should the President resolve to use his executive powers to create a data base or any other regulatory provision, it is far more likely that such regulation would fall within the ambit of the Justice Department — not Health & Human Services — and nothing in the ACA prevents such data collection, or any other regulatory efforts, which would fall outside the limited jurisdiction created in Obamacare with respect to firearms.

    So, to our friends at Breitbart and the others who believe they have discovered gold in their effort to prevent the administration from acting on its desire to bring sanity to our gun laws, I’m afraid you are going to have to reload as Obamacare is just not the magic bullet you are looking for.]

    Are you kidding? Reid and Sadim by law are supposed to pass a budget each year, still waiting. By his own word the public was supposed to have 5 days to read new law, Three years later we still do not know what Sadim Care contains. By law he is ordered to protect our borders, and providing guns to drug runners to kill our border agents by no stretch comes close. And we still have not seen any concrete evidence that those responsible for the the Benghazi tragedy have been dealt with, yet he has decided the act of a mad man is reason enough to ignore the Constitution. No I have no misgivings that anything that stands in his way will ever be obeyed.

    #3 Sasja is correct. We need to stop concentrating on just Dems. We need to fix our own mess first, and the corruption in the GOP is the real reason the country has fallen apart. The fact that the GOP has become just as corrupt leaves voters with no viable options at the voting booth.

    How about each and every person who reads this comment immediately pick up the phone and contact Darrell Issa. Ask him why, with all of the hundreds of so-called “investigations” he’s done in the last four years, not a single person has been charged with a crime. Tell him to stop with the smoke and mirrors and to actually do his job, instead of simply pretending to be outraged and then doing absolutely nothing about it.

    Ask him why the GOP is allowing rampant violations of the Constitution and doing absolutely nothing about it other than to pound their fists on the table and say they’re angry.

    DO IT! If you simply read these stories every day and then go about your day without doing a [email protected] thing about it, you’re just as much a reason for the problems as anyone. It takes two minutes. Write him an email. DO IT NOW.

    Nice. Not only do they get stung by one of their favorite tactics, but it originated from one of their ranks as well.

    Every single bill from here on out is worth reading in its entirety, as it certainly isn’t beyond the gun-grabbers in Congress to bury some other measure in some other bill that invalidates this one.

    Sorry, I question the validity of this claim. My healthcare provider has twice in the past year asked me whether there are firearms in my home.

    I read this to apply to the Secretary of HHS who is granted a lot of powers under PPACA (Obamacare). Basically its a prohibition on your doctor asking if you use guns or have guns or ammo at home and on the Secy HHS for keeping a record of gun or ammo ownership.

    I see nowhere that it applies to DoJ, Attorney General, ATFE, etc.

    HR3590 has more than 2000 pages but here is a summary, only 49 pages…..

    In the HR3590 summary, the words “Requires the Secretary” (of HHS) appear 98 times and “Directs the Secretary” appears 64 times. “Authorizes the Secretary” appears 30 times. The law gives a tremendous amount of power to one individual, Kathleen Sebelius, who was NOT elected by The People and who “serves at the will of the President”.

    More than 18 million people were without healthcare insurance but Obamacare transforms the entire national health care system and affects all residents of the U.S., not just the 18 million. We now have a humongous mishmash of rules and regulations and taxations that intrude and affect every aspect of our lives.

    After reading only some this information it appears that the Affordable Health Care Act is a wolf in sheep’s clothing. The good stuff, coverage for children under 26 years old and pre-existing coverage were initiated first. Then the heavy fines and taxations and mandates take effect in 2013 or later, after the November election.

    The Obama Administration has already handed out 111 Obamacare waivers to US companies. Unfortunately, if you’re a small business or don’t have connections you can’t get a waiver for your company. And there are some select groups who are exempt (Prisoners, illegal aliens, and foreign nationals, Amish, Mennonites, Scientologists and some Muslims). I think that Issuing waivers and exemptions to certain groups of people provides unequal treatment under the law. All laws should apply to all people. Just my opinion.

    Islamists Insert Themselves into Healthcare Debate

    [What is remarkable and at issue here, is certainly not the right of MPAC’s leadership to have a personal opinion on health care policy. But what is most telling is how these Islamist organizations have a way of finding a way to worm themselves and their Islamization agenda into every political issue related to government under the name of Islam and Muslims. As is typical of Islamists, they exploit Muslim faith based organizations and their often unsuspecting supporters and members for their own very specific domestic and foreign policy agenda of the day. This agenda clearly and malignantly crosses the line of mosque and state in an aim to impose the Islamization of every topic related to the domain of government and public policy upon the Muslim community and ultimately the greater American community.

    Does this ring a bell? It’s the modus operandi of the Muslim Brotherhood (MB). They are a well known political party in Egypt with a specific political platform that has now metastasized around the world into hundreds of splinter groups with a headquarters also in London. Ultimately that political platform is Islamism (a.k.a. Political Islam). Islamism is specifically the desire to somehow put shar’iah law (Islamic jurisprudence) into place in government through a legal system not based in reason but rather based in clerical exegesis of Islamic jurisprudence. The Brotherhood is the predominant global face or front of that movement.

    When it comes to domestic policy stances, one can usually pick out MB politics from a mile away. On economic issues, the Islamist (MB) platform is heavily socialist based in government entitlement programs. They thus will see common cause on economic issues with the left in the United States. On social issues, the Islamist platform is focused on their own version of family values and they will try and seek common cause with the right in the U.S. on those issues. Just in these two examples it begins to become more clear that Islamists are neither Democrat nor Republican. On foreign policy their stances are also easily identifiable. They have their own political platform—Islamism. They advocate for Western isolationism in order to allow for unimpeded advancement of Islamist movements globally. Forget any advocacy for liberty. They are doves as minorities from within the West so that their brothers can be hawks from within Muslim majority nations so they can impose and spread Islamism abroad. In domestic and foreign policy politics they will support whichever party stands less of a threat to the advocacy of the transnational Islamist agenda.]

    The Democrats got burned by their own tactics of inserting or attaching other crap to bills, sneaking them through when due diligence in fully knowing their contents isn’t exercised by Congress before casting votes on those bills. In this case, a random and unexpected event brought to light these gimmicks, revealing the Democrats as being in the humiliating position of being both proprietor and victim.

    I’m pretty sure those “restricted-access medical records” can be accessed by other federal agencies…

    The wording in the healthcare bill doesn’t do what people want or obviously think. It only prevents: “‘‘(1) WELLNESS AND PREVENTION PROGRAMS.— A wellness and health promotion activity implemented under subsection (a)(1)(D) may not require the disclosure or collection of any information relating to—” and the Secretary of HEALTH AND HUMAN SERVICES from enacting laws regarding gun control and data collection. It doesn’t say a word about the Attorney General of the US, the President or any other cabinet member (such as Homeland Security).

    Want to get angry about something – just think about where potential gun restriction and gun seizure laws will be originated and enforced: Homeland Security. The same agency that has given us senior citizen diaper exams at airports, strip searches of the elderly, made us take our shoes off, and X-ray machines that show your body naked through your clothes will be disarming us. I choose to fly and thus I have chosen to live by those rules (so far). But gun seizure AT MY HOUSE (if they try to go that far) is a whole different story…
