A Fraud Has Been Perpetrated On the American Citizenry

Democrats told us Obamacare was not a tax. Then they went before the Supreme Court and argued that it was a tax. Now they’re saying it’s not a tax again.
The American Spectator reported:

Critics of the majority’s decision will say for the foreseeable future that Chief Justice Roberts rewrote Obamacare to save it. Michael Carvin, who argued against Obamacare before the Supreme Court, noted dryly, “I’m glad he rewrote the statute instead of the Constitution.”

Carvin’s summary of the Supreme Court’s ruling was on target: “What the Obama Administration… thought they were doing was completely unconstitutional; what they lied to the American people about was constitutional.… Unfortunately they got away with that bait-and-switch. A fraud has been perpetrated on the American citizenry.”

In oral arguments before the Supreme Court, the administration’s attorneys argued — as they knew they had to — that the mandate was constitutional as a tax. This despite the fact that Democrats passed Obamacare by stating specifically and repeatedly that the mandate was not a tax, including a testy response by President Obama himself to unusually challenging questioning by ABC’s George Stephanopoulos in 2009.

As recently as a few months ago, President Obama’s budget director said in a Congressional hearing that the mandate is not a tax, with Health and Human Services Secretary Kathleen Sebelius saying “it operates as a tax, but it is not per se a tax.”

If the bill had been marketed to members of Congress and the public as a tax, it is unlikely that even the Cornhusker Kickback and the Louisiana Purchase would have been enough to pass the law, despite the large Democrat congressional majorities at the time. Senator Lindsey Graham (R-SC) said that “if it had been seen as a tax, they wouldn’t have gotten ten votes, much less sixty.”

As for those Democrats in Congress who have argued, and may continue to argue, that the Obamacare mandate is not a tax, Graham said “they either don’t know what they’re doing, or they lied to us. So this is a huge issue in the fall.” Graham called for every Congressional Republican who is up for election to ask their Democratic opponents whether they support this tax increase; given that Democrats have little choice but to support Obamacare, this is the political equivalent of asking someone if he has stopped beating his wife yet, and a solid political tactic.

Nearly 75% of ObamaTax costs will fall on the backs of those Americans making less than $120,000 a year.

Democrats forgot to tell us this.

  5. 0bama and the dems are deadmeat… in 2012. …Romney can use this as a lightning rod to solidify all the opposition against 0bamacare and direct it at 0bama. (it should be more than enough to take 0bama down in 2012…) you all saw the huge losses they got in 2010.

    republicans only need to bring this up every time in this coming election and it will turn voters off to the dems… hell they could even try a budget reconcillation vote…. and because the dems cannot be seen as being in favor of 0bamacare (cuz voters will kill them) they would have to vote to repeal it.

  6. By saying that The Unpleasantness is a tax, Roberts has severely diminished the credibility of the Court. He has deemed the law Constitutional on a basis other than that which it was fraudulently sold to members of Congress, and the public. He has re-written the law, and in the process greatly expanded Congress’ taxing authority beyond that which is enumerated in the Constitution.

    The power to tax is the power to destroy. In this case, Judge Roberts has destroyed a significant personal freedom, that of people to choose their own plan for health insurance.

  8. I am thrilled with the Supreme Court decision. Not because I support obamacare but because the mandate is no longer a mandate. IT IS A TAX. the largest tax increase in the history of the world. $1,700,000,000.00. If the American people vote for this, that is their choice but i don’t believe for a nannosecond that they will.

    was it not the job of the justices to rule on the law as it was written? was it the job of the supremes to rewrite the law so it could pass?

    i didn’t think the supremes were to make laws, just judge what is written before them!

    now since this stooge of a “judge” has rewritten obama’s law as a tax, shouldn’t this have to go through the house again to be voted on?

    or can the house defund this obamacare?

    you know after this fiasco by the supremes, i just don’t see the need to have them anylonger. these judges are too political.

  11. A tax hike in the middle of a recession is something the GOP has to pound into the heads of every voter in every state and Congressional district. The young people who bought the BS of Obama’s ‘Hope and Change’ will need to be shown just how much that ‘Hope and Change’ is going to cost them. Not only just the new few years but the rest of their lives.

    Show the voters the dollars and cents that will be taken out of their pockets, but their kids’ and grandkids. Then show just what they will get for their sacrifice: nothing. Nothing in health care will be improved, but the size and power of the Federal government to control their lives will increase.

  13. Sen. Graham, I’ll go with ‘they lied to us’, since this is what dems always do. We are seeing Chicago politics full blown in front of our faces. I know, it ain’t pretty and if Prezzy No Taxes For the Middle Class gets reelected, we’re going to see this take off on steroids.

    Given that the SCOTUS declared a monetary “penalty” to be a tax, I guess now I can deduct traffic and parking tickets under “Taxes other.”

    Got fined by the EPA, FTC, FCC, SEC … deduct it .. they are now taxes
    Got a penalty for early withdraw of 401(k) funds … deduct it .. they are now taxes

    You’re assuming that the talking heads will actually approach that aspect of the decision. The Democrats could be lopping the heads off virgins and using their heads for soccer balls and the media WILL NOT highlight that in their reports.
