DEMOCRATS LIED: They Told Us Obamacare Was Not a Tax… Then Argued in Court That It Was a Tax… Now They’re Saying It’s Not a Tax Again

Democrats told us Obamacare was not a tax.
Then they argued before the Supreme Court that it was a tax.
A fraud was perpetrated on the American people.

They said it wasn’t a tax.

A Fraud Has Been Perpetrated On the American Citizenry

Democrats told us Obamacare was not a tax. Then they went before the Supreme Court and argued that it was a tax. Now they’re saying it’s not a tax again.
The American Spectator reported:

Critics of the majority’s decision will say for the foreseeable future that Chief Justice Roberts rewrote Obamacare to save it. Michael Carvin, who argued against Obamacare before the Supreme Court, noted dryly, “I’m glad he rewrote the statute instead of the Constitution.”

Carvin’s summary of the Supreme Court’s ruling was on target: “What the Obama Administration… thought they were doing was completely unconstitutional; what they lied to the American people about was constitutional.… Unfortunately they got away with that bait-and-switch. A fraud has been perpetrated on the American citizenry.”

In oral arguments before the Supreme Court, the administration’s attorneys argued — as they knew they had to — that the mandate was constitutional as a tax. This despite the fact that Democrats passed Obamacare by stating specifically and repeatedly that the mandate was not a tax, including a testy response by President Obama himself to unusually challenging questioning by ABC’s George Stephanopoulos in 2009.

As recently as a few months ago, President Obama’s budget director said in a Congressional hearing that the mandate is not a tax, with Health and Human Services Secretary Kathleen Sebelius saying “it operates as a tax, but it is not per se a tax.”

If the bill had been marketed to members of Congress and the public as a tax, it is unlikely that even the Cornhusker Kickback and the Louisiana Purchase would have been enough to pass the law, despite the large Democrat congressional majorities at the time. Senator Lindsey Graham (R-SC) said that “if it had been seen as a tax, they wouldn’t have gotten ten votes, much less sixty.”

As for those Democrats in Congress who have argued, and may continue to argue, that the Obamacare mandate is not a tax, Graham said “they either don’t know what they’re doing, or they lied to us. So this is a huge issue in the fall.” Graham called for every Congressional Republican who is up for election to ask their Democratic opponents whether they support this tax increase; given that Democrats have little choice but to support Obamacare, this is the political equivalent of asking someone if he has stopped beating his wife yet, and a solid political tactic.

Nearly 75% of ObamaTax costs will fall on the backs of those Americans making less than $120,000 a year.

Democrats forgot to tell us this.

Obama is looking good for a second term.

The highest court just gave him a thumbs up.

    The media is behind him.

Holder shrugged off the “contempt” vote.

And the Republicans look like vindictive and insensitive fools chasing Holder and Obamacare.

Gonna be very, very hard to unseat him.

  • This may make you feel a bit more optimistic:

0bamaTax is a tax. The Supreme Count ruled so… um… I cannot see the teleprompter. Please adjust it. Thank you.

    0bamaTax is a huge tax… um… a large Penalty… I still can read the teleprompter.

    I’ll get this time.

Let me be clear, 0bamaTax is a huge Tax Penalty! Ok, it’s both a Penalty and a Tax… I can lie with the best of them. I can swing like a gate. I am the best liar this country has ever had and you should vote for me. That is the big difference between me and my opponent.

My opponent’s religion precludes him from telling lies. I can lie with impunity. I do it daily. My lies have brought in $110,000,000.00 for my campaign. My opponent cannot lie and he has one-sixth of that amount of money. I lie and it pays well.

Yes, it true, I lie about my opponents Super Pac. My Super Pac is much bigger. But, David Axelrod is super-expensive. In fact, I lost $5,000,000.00 last month. David Axelrods huge fees were the cause. David Axelrod sucks. But, so does my campaign and that is why I have not fired him… even though is should. My donors keep asking where is the money going. It’s going into Axelrod’s pocket.

This is your leader twittering. “This is important. Pitch in $3 before midnight”

    http://michellemalkin.com/2012/07/01/what-was-obama-doing-on-his-flight-back-from-colorado-springs-wildfire-sightseeing-trip/

Ah, crap it’s past mid-night. Do not fret. It’s not midnight in China. And, I will run the same chity ad tomorrow night.

My Jumbo Jet is spewing fumes and I feel sick… because my donors are tapping dry or possibly they think I am a stealing them blind. Its true I dipped into my funds to pay Eric Holder’s legal fees. I only stole a few million dollars. I cannot answer any more questions. Good day.

0bama and the dems are deadmeat… in 2012. …Romney can use this as a lightning rod to solidify all the opposition against 0bamacare and direct it at 0bama. (it should be more than enough to take 0bama down in 2012…) you all saw the huge losses they got in 2010.

republicans only need to bring this up every time in this coming election and it will turn voters off to the dems… hell they could even try a budget reconcillation vote…. and because the dems cannot be seen as being in favor of 0bamacare (cuz voters will kill them) they would have to vote to repeal it.

  • Robert

By saying that The Unpleasantness is a tax, Roberts has severely diminished the credibility of the Court. He has deemed the law Constitutional on a basis other than that which it was fraudulently sold to members of Congress, and the public. He has re-written the law, and in the process greatly expanded Congress’ taxing authority beyond that which is enumerated in the Constitution.

The power to tax is the power to destroy. In this case, Judge Roberts has destroyed a significant personal freedom, that of people to choose their own plan for health insurance.

once the American people fully realize that LOWBAMACARE is 21 new taxes. TWENTY ONE.
there 21 new taxes equals $1 trillion seven hundred billion dollars. THAT IS ONE THOUSAND SEVEN HUNDRED BILLION DOLLARS OF OUR MONEY. and of course, that’s what it is now. with the bungling, never right dopes that do the accounting, the total will double, as it usually does. LOWBAMACARE will bankrupt the nation. this issue alone, is made clear to all Americans, will send LOWBAMA back to chicago where he will be rich, very very rich, but gone.

  • max arlington

I am thrilled with the Supreme Court decision. Not because I support obamacare but because the mandate is no longer a mandate. IT IS A TAX. the largest tax increase in the history of the world. $1,700,000,000.00. If the American people vote for this, that is their choice but i don’t believe for a nannosecond that they will.

    robert sucks.

so they cannot make us have insurance thru the commerce clause, but they can make us have insurance thru taxation?wtf?

was it not the job of the justices to rule on the law as it was written? was it the job of the supremes to rewrite the law so it could pass?

i didn’t think the supremes were to make laws, just judge what is written before them!

now since this stooge of a “judge” has rewritten obama’s law as a tax, shouldn’t this have to go through the house again to be voted on?

or can the house defund this obamacare?

you know after this fiasco by the supremes, i just don’t see the need to have them anylonger. these judges are too political.

A tax hike in the middle of a recession is something the GOP has to pound into the heads of every voter in every state and Congressional district. The young people who bought the BS of Obama’s ‘Hope and Change’ will need to be shown just how much that ‘Hope and Change’ is going to cost them. Not only just the new few years but the rest of their lives.

Show the voters the dollars and cents that will be taken out of their pockets, but their kids’ and grandkids. Then show just what they will get for their sacrifice: nothing. Nothing in health care will be improved, but the size and power of the Federal government to control their lives will increase.

  • StrangernFiction

I am thrilled with the Supreme Court decision.

Part of me applauds your optimism, but it’s a small part.

  • Kissmygrits

Sen. Graham, I’ll go with ‘they lied to us’, since this is what dems always do. We are seeing Chicago politics full blown in front of our faces. I know, it ain’t pretty and if Prezzy No Taxes For the Middle Class gets reelected, we’re going to see this take off on steroids.

  • Neo

Still looking for a silver lining in the ObamaCare decision ?

Given that the SCOTUS declared a monetary “penalty” to be a tax, I guess now I can deduct traffic and parking tickets under “Taxes other.”

Got fined by the EPA, FTC, FCC, SEC … deduct it .. they are now taxes
Got a penalty for early withdraw of 401(k) funds … deduct it .. they are now taxes

  • Tomorrow on the Sunday morning shows Democrats are going to go out and lie again that ObamaTax is not a tax.
They hope that you’ll believe them.

You’re assuming that the talking heads will actually approach that aspect of the decision. The Democrats could be lopping the heads off virgins and using their heads for soccer balls and the media WILL NOT highlight that in their reports.
    Cheers,
    The Worm

  • I hate Democrats. I effin’ HATE them!

It is painfully obvious that our .gov is at war with its own citizens, all three branches!

Does anyone actually believe the 2012 election will solve this? We said that in 2010!

The flagwaving, sign carrying protests, petitions did absolutely nothing!

The question before American citizens now is what is the next move?

Here is some food for thought:

Very hard decisions will have to be made.

Be prepared in all aspects of your lives.

A suggestion. Many who attend church, whether Catholic or Protestant, approach the leadership and press them why they are Silent on the evils facing America today and the evils about to come to the Body of Christ!

If said leadership refuses to start speaking out, exposing and confronting the evils of the day, get the hell out of that church!

“If you will not fight for right when you can easily win without blood shed; if you will not fight when your victory is sure and not too costly; you may come to the moment when you will have to fight with all the odds against you and only a precarious chance of survival. There may even be a worse case. You may have to fight when there is no hope of victory, because it is better to perish than to live as slaves.”

Has anyone seen this as political murder ? That justice knew what he was doing when he said it could be upheld as a “tax”. It was sold to the people as “not a tax”. Hey Barry, call Al Gore, tell him to make it rain in Colorado, then figure out how your ivy league butt insults our intelligence again. Look into HHS regs on post 72 year patients and advanced neurological care. No death panels, huh ??? If an agitator can occupy 1600, I can be a brain sugeon.

  • Pingback: WSJ Chief Economist: 75% of Obamacare Costs Will Fall on Backs of Those Making Less Than $120K a Year | Conservative News, Views & Books()

  • For a while, conservatives were expressing displeasure at the idea that 49% of the American people pay no taxes at all. That was a faulty argument. And the argument that the burden of Obamacare will fall on the poorest Americans is also faulty. People who have private insurance are also relatively wealthy. The uninsured lower-middle class Americans who have to pay a monthly premium will pay, yes, but that is part of the shared responsibility. I am not a fan of Obamacare but I am not a fan of ridiculous arguments either.

No more [demographic deleted] in the White Hut!

  • tramky

The semantics don’t matter one whit! Who cares if it’s a ‘tax’ or a ‘penalty’? Either way, it is the Federal government pulling money out of your pocket under duress and with the power of enforcement by the Internal Revenue Service, whose powers are considerable.

The media–not even Fox News–has yet to tell us about the enormous expansion of the Internal Revenue Service, and the enormous role it will play in HEALTH CARE–YOUR health care. Who would ever have thought it possible that the IRS would become the massive monitor for this or ANY health care system. But you simply won’t believe just how close & personal the IRS will be with the ACA–you just won’t believe your eyes. The IRS will be ALL OVER your life, will be ALL over your personal mail, will be ALL OVER your job and your employer–on a MONTHLY basis. You will have more contact with the IRS in one month of the ACA than you have had in the entirety of your adult life.

The IRS is hiring thousands of new staff and agents to deal ONLY with the ACA and the enormous role the IRS will play in its administration. It is ALL about the money–YOUR money. They will want it, and they will want it NOW!

When’s the last time YOU got a bill from the IRS? Well, with the ACA, millions of Americans will get bills from the IRS, and you won’t believe your eyes.

  • ablubud

Another Moore lie. This “tax” falls on the lower incomes because THEY are the freeloaders without insurance. Only 4 million of our 300 million will pay this “Freeloader Tax”.

  • top

According to U.S. Census figures, $120,000 and below earners are 93% of the income distribution. The means that the top 7% will be paying 25% of Obamacare costs which is the real complaint. The only fraud here is how the Republicans and their lackeys are lying to Americans.

  • george

Why isnt Romney going to push Obama on the tax issue? Well…

“For those that have higher incomes, we expect them to have health insurance. And if they don’t, we’re going to withhold their tax refund or put in place other penalties to assure that everybody comes in the system.” – Romney, proposing Romneycare as a solution for the nation on FOX, before Obama warmed up to the idea.

If you can get past the word ‘tax’ and the Limbaugh induced blind anger, you might eventually get to the question of ‘Hmm how much does it cost society when someone chooses not to purchase insurance?’ The answer to this explains pretty well the personal responsibility mechanism of the ‘mandate’, why the Heritage Foundation came up with the idea, why the Gingrich house advocated for the mandate/tax in the 90s, why Romney supported the mandate/tax in Mass., and why Obamacare is essentially the same ‘anti-free loader’ policy the GOP has been advocating for for decades. True story. Interestingly, the only substantial difference between Romneycare and Obamacare is that Obamacare doesnt pay for abortions and coverage of illegal immigrants. Still think the GOP should make the election about Obamacare?

“The President directed us to do it…” or words to that effect….BUT NOTICE THIS:

On December 3, 2009 it was announced that he would be resigning his post and returning to private practice in February 2010. [9][10]

According to news accounts, Ogden stepped down in part because of disagreements with Attorney General Eric Holder over management issues.[11]

@Dick. sorry, but you are wrong, it originated in the HOUSE, not the SENATE.

    (http://tinyurl.com/ObamacareWiki ):

“The Senate failed to take up debate on the House bill and instead took up H.R. 3590, a bill regarding housing tax breaks for service members. As the United States Constitution requires all revenue-related bills to originate in the House, Senate took up this bill since it was first passed by the House as a revenue-related modification to the Internal Revenue Code. The bill was then used as the Senate’s vehicle for their health care reform proposal, completely revising the content of the bill. The bill as amended incorporated elements of earlier proposals that had been reported favorably by the Senate Health and Finance committees.”

I don’t know the answer~~ I wouldn’t have a clue… I can tell you I’ve had 27 surgeries and now an ileostomy. I have to care for my mother who has dementia or throw her in a nursing home.. she is still very aware but cannot care for herself. I’m not eligible for insurance,, period. There is a big group insurance possibility that is about $600 a month. Seriously,, ?? I know it’s a mess now. I don’t know if this would ever even get me insurance. So~~~~ just what is the answer. I’ve been turned down by every insurance attempt made for years. Every penny we have goes for ostomy supplies and living. I agree it needs to change but what is the answer????
