The Obama White House has asserted executive privilege over documents related to the ‘Fast and Furious’ scandal.

This morning, the White House asserted executive privilege over documents related to Operation ‘Fast and Furious,’ per Attorney General Eric Holder’s request. Following this move, Judge Napolitano warned that we may be on the “precipice of a constitutional confrontation between the executive branch, the White House, and the Congress.”

Executive privilege, in its definition, provides protection over communications with the president himself. The letter sent by Eric Holder requesting executive privilege does not detail a discussion with the president, but Judge Napolitano said, “The implication is there.”

    As much as I’d like to see Obozo impeached, that is not the right strategy going into the election.

    It would make him appear to be being picked on by the GOP – victim of a witch hunt. No, the best attack is to keep putting this out there sort of low key. Just keep reminding people that hundreds died due to Fast and Furious and in the aftermath the White House and DoJ are doing their best to cover up and cloud the issues.     Unfortunately, you can impeach all you want (which occurs in the House, which Republicans control). Impeachment is just charging with a crime. The actual TRIAL for that crime occurs in the Senate (controlled by Democrats), and there’s no way any Democrat would get convicted.

    That said, I hope they stick it to Holder and Obama. Anyone who has the gall to testify that the phrase “fast and furious” in an email do not refer to the operation Fast and Furious, and to answer “I don’t know” to half the questions needs to be knocked down a peg or ten.

    There are commercials on the radio now where Holder is whining about people not buying counterfeit items. How about you worry a little more about not running guns and killing Americans, and a little less about counterfeit items, Holder?

    I myself think it to be in the best interest of all involved to bring impeachment articles on both. The dems would then have the ability to run someone else, as Obama is finished. The Rep. will be seen as trying to uphold the law and constitution. Win Win for every body, especially the country and the world.

We all knew that when the fire got too hot that Obama surely would have to come in with a water hose and try his best to put out the flames. Obama and Holder know that they under any circumstance cannot release any more if these documents. Doing so will show/ prove their direct involvement in the F&F program. It will prove on paper with signatures to boot that they, these two were in fact the creators of the program. They know that turning over anything at this point will doom them both.     Just to give you a feeling for how lopsided the sample of this poll must be, democrats enjoy a 7 point advantage in Generic Congressional Preference. That is 14 points HIGHER than Rasmussen who polls only likely voters and does his poll weekly.

    My guess is this is the most obscenely biased polling sample done in recent memory (and that’s saying a lot).

    I mean the RCP average is a tie right now and Obama suddenly goes +13? Why, because of the great week he just had? Lol.

    There is a history from George Washington to this day of presidents claiming a right to withhold information from Congress. A more recent Supreme Court ruling concerned Nixon and the Watergate tapes.

    From Legal Dictionary, in part:

    “….when Congress sought to obtain White House tapes containing Oval Office conversations, Nixon refused to turn them over, claiming that the tapes were subject to absolute executive privilege and asserting that the judiciary had no authority to order their production or inspection. Eventually the dispute reached the Supreme Court, where, in ‘United States V Nixon, 418 U.S. 683, 94 S. Ct. 3090, 41L Ed. 2d 1039 (1974), the Court stated that ‘neither the doctrine of separation of powers, nor the need for confidentiality of high level communications, without more, can sustain an absolute, unqualified presidential privilege of immunity from judicial process under all circumstances.'”

    “In it’s opinion, therefore, the Court explicitly recognized the president’s authority to assert executive privilege but ruled that the use of executive privilege is limited, not absolute.”

    “While the Court affirmed the use of executive privilege, therefore, it determined that in this case, the right of the U.S. people to full disclosure outweighed the president’s right to secrecy.”

    This last paragraph, in my mind, is that the U.S. people’s right to know about Fast and Furious outweighs the president’s right to secrecy.

    Executive Privilege is exercised by the Executive Branch when it is perceived that there is in danger, compromise or threat to that Branch by actions outside the Branch.

    Does this mean that the information being sought by Issa’s committee endangers the Executive Branch?

    Does it mean that Obama or his staff participated in Fast and Furious?

    If not, why exercise an Executive Privilege in this matter?

    Does Obama realize that his action today just implicated the White House?

    There will never be impeachment proceedings instituted against the first Black President. At least this is what Obama’s counting on. Its clear now why Obama decided to divide this country as he runs for a second term instead of trying to appeal to the entire nation. Perhaps the leaders of the Democratic Party will decide to dump Obama or maybe the leaders of both parties will work together to force him to resign the Presidency.     #9, in United States vs. Nixon the Supreme Court ruled that executive privilege only applied to direct communications OF THE president. It does not apply to communications between bureaucrats in the administration.

    If, and this is a big IF, the President is exercising his executive privileges, it can only be applied to those documents that were in direct contact with the president (i.e. Holder’s memos to Obama).

    The SCOTUS rules that Nixon had to release Oval Office tapes “in the public interest” although those tapes were considered the private conversations of Nixon. Those Nixon phone conversations would be considered no different than email/memo communications with the current president. The ruling asserted that the president did not have executive privilege in the coverup of a crime.

    F & F was a crime, including a crime against another nation’s sovereignty, as guaranteed by treaty, as well as a crime against federal gun laws.

    I read the articles at the links, and I think it is possible to tease out where this story stands. This story shows proper use of historical links.


    Below is a statement released by Senator Chuck Grassley about President Obama’s assertion of executive privilege over documents related to ‘Fast and Furious.’

    “The last-minute assertion of executive privilege by the President regarding the Fast and Furious documents is itself evidence of the Attorney General’s contempt of the congressional oversight process.

    “At no point in the last 18 months since I started asking questions has the Department hinted that there was a potential that the documents might be subject to executive privilege. That includes the face-to-face meeting with the Attorney General last night. (More…)

    “Is it possible that there were no prior discussions with the White House about this move until after the meeting last night? Talk about gamesmanship. If it were a serious claim, they would have and should have raised it last night, if not much earlier.

    “Now that executive privilege has been asserted, it raises monumental questions. How can the President assert executive privilege if there was no White House involvement? How can the President exert executive privilege over documents he’s supposedly never seen? Is something very big being hidden to go to this extreme?

    “The contempt citation is an important procedural mechanism in our system of checks and balances. The questions from Congress go to determining what happened in a disastrous government program for accountability and so that it’s never repeated again.”

    The other link leads to a copy of a letter by Eric Holder to the President, which reads in part:

    “The Committee has made clear that its contempt resolution will be limited to internal Department “documents from after February 4, 2011, related to the Department’s response to Congress.” Letter for Eric H. Holder, Jr., Attorney General, from Darrell E. Issa, Chairman, Committee on Oversight and Government Reform, U.S. House ofRepresentatives at 1-2 (June 13, 2012) (“Chairman’s Letter”). I am asking you to assert executive privilege over these
    documents. They were not generated in the course of the conduct of Fast and Furious. Instead, they were created after the investigative tactics at issue in that operation had terminated and in the course of the Department’s deliberative process concerning how to respond to congressional and related media inquiries into that operation.”


    My best guess is that the Committee is going after the cover-up, rather than any written order or supporting memo that would have been a natural part of legitimate executive action. Holder has made multiple assertions that neither he nor the President were involved with this operation. Sen. Grassley’s position is that, if the President wasn’t involved, there should be no need for legal advice to him on how to handle the matter.

    Unfortunately, this does deal with an international incident, so the executive branch can claim that undue harm would be done to the nation if the internal communications of the executive branch were provided. This, in my admittedly basic understanding, is the purpose of executive privledge. In other words, Mexico would be really pissed if the whole story is made public. This might not be true, but Obama can make that case.

    Obamarule and the killing of the Constitution of the United States

    If last Friday’s dictatorial action by President Obama is allowed to
    stand, historians may someday look back on June 15, 2012 as the
    day the Constitution died.

    The rule of law has been replaced by Obamarule.

    The Founding Fathers designed the Constitution
    to limit the power of politicians.

    They had fought an eight year war
    against the tyranny of King George.

    Arbitrary personal decisions that allowed the King to pick winners
    and losers was a significant part of their grievance against the
    British Monarchy.

    They relied on Montesquieu’s theory of divided power
    to protect freedom and liberty from politicians.

    Now, in one bold move worthy of Cesar Chavez or Vladimir Putin,
    President Obama has added the role of Congress to that of president.

    This may sound melodramatic, but that is only because of the cynicism
    and shallowness of the modern news media and modern politics.

    In declaring that his administration will not deport those who came to this
    country illegally at a young age, President Obama has suspended the law
    for approximately 800,000 young people.

    In truth, no one knows how many people will be covered by Obamarule.
    Will more come into the United States while the regulations are being
    written? Which bureaucrat decided in secret it covered 800,000 people
    and what was their analysis based on?

    Why people 16 and under? Why not 15? Why not 17? Why was serving
    less than one year in jail okay? Why not zero jail time? Why not 18 months?

    How can we verify they have earned an authentic
    G.E.D. certificate rather than merely bought one?

    Why is it a two year waiver rather than a five year waiver?

    If Obama has had this power all along
    why didn’t he use it in January 2009?

    The point is not that the United States does not need comprehensive
    immigration reform. Indeed, immigration reform could help spur the
    economy and create domestic stability for families here illegally. The
    point is that we must debate such policy ideas within the proper
    channels of the legislative branch instead of by executive fiat.

    One of the major purposes of the legislative process is to get
    questions like these out in the open so citizens can see the

    Another major purpose of the constitutional division of
    power is to ensure that no one person can write laws.

    In this case the Constitution is clear that Congress
    sets the rules for naturalization and citizenship.

    Finally, the power of Congress to control the executive
    branch includes the power of the purse.

    No money has been appropriated to pay for Obamarule. Any money
    spent on its implementation without Congressional authorization and
    appropriation would be clearly unconstitutional and illegal.

    No president in our history has been as willing
    to destroy the Constitution as Obama.

    Under the shallowness and cynicism of our Washington establishment
    we are drifting toward a genuine Constitutional crisis.

    This has GOT to involve DHS! There’s NO WAY it could be done without it!!! They are probably ALL involved. I just hope we can get TRUTH and let the chips fall where they belong!!! Those dead, all of them, as well as WE THE PEOPLE, deserve no less. PJ Media had an article when F&F vs Congress began, regarding all the INTERNATIONAL LAWS that were BROKEN!!! Why is no one discussing THIS ASPECT??? I could NEVER be implemented, or even considered, without ALL the agencies involved!!! DEA, ATF, DHS, and every other alphabet agency, AS WELL AS THE WHITE HOUSE, since it is INTERNATIONAL!!!

    I hope our country’s basic rule of the land can even survive this admin. They are so lawLESS. I Pray….

    It was a really ugly link, wasn’t it? That link is to a search page, and it includes the search terms. I tried to find a direct link to the article, but nothing else worked.

    I’m still watching C-SPAN 3: DOJ hasn’t even produced a log of privileged documents.

    This is unprofessional on the part of DOJ.

  • Let me get this straight.
    1. The Administration claims Fast and Furious was implemented by the DOJ by underlings that had absolutely no communication with the President, or even Holder until they read about it in the papers.
    2. The communications of the President between Holder and his underlings are supposed to be protected under the Executive Privilege part of the Constitution.

    I’m having a hard time seeing the Intersection of those two Sets without drawing a Null. Far more likely is Set 1 is invalid and needs to be replaced. In November.

    a) Obama cannot survive and loses his pension/Secret Service protection for life
    b) Holder cannot be pardoned by Obama if his presidency survives.

    He won’t get away with it. The Supreme Court ruled against Richard Nixon during Watergate. I think it’s safe to say, Obama orchestrated the framing of Americans, and the murder of two Federal Agents and over 300 others. He’s a cold, calculating, psychopath.
