    It’s called “interpretation,” and is, apparently, something the rest of us are too stupid to do. Forget that the US Constitution was intentionally written in plain, simple, easy-to-understand, common English so that “interpretation” by elitists wasn’t/isn’t required. They’re appointed and paid the big bucks to “interpret” the hell out of that document so that it means whatever they want it to mean.

There were not five votes to uphold it on the ground that Congress could use its power to regulate commerce between the states to require everyone to buy health insurance. However, five Justices agreed that the penalty that someone must pay if he refuses to buy insurance is a kind of tax that Congress can impose using its taxing power. That is all that matters. Because the mandate survives, the Court did not need to decide what other parts of the statute were constitutional, except for a provision that required states to comply with new eligibility requirements for Medicaid or risk losing their funding. On that question, the Court held that the provision is constitutional as long as states would only lose new funds if they didn’t comply with the new requirements, rather than all of their funding.

    A Supreme Court Justice may be impeached by the House of Representatives and removed from office if convicted in a Senate trial, but only for the same types of offenses that would trigger impeachment proceedings for any other government official under Articles I and II of the Constitution.

    Actually far more Americans travel to other countries for medical care than foreigners who come here. I just read that an insurance company (forget which one) will begin paying for medical proceedures performed in other countries in order to save money.

    As today showed holding out hope is virtually a lost cause. Chief Justice Roberts was held up as being nearly as conservative a justice as Scalia. Romney is as much a blue blood moderate who has repeatedly shown he will take the course of least resistance and go all squish if there is the slightest amount of opposition.

    History may very much point out today’s decision on ObamaCare to be as pivotal as the Dred Scott decision was for determining peace or civil war.

    I’d like your optimism, but the last time we had a GOP Congress and Pres, they only offered us tax cuts. All well and good, but no action on anything else. Man does not live on tax cuts alone.     Take a quick look at Footnote 11, which is on page 44 of the slip opinion: Those subject to the individual mandate may lawfully forgo health insurance and pay higher taxes, or buy health insurance and pay lower taxes. The only thing that they may not lawfully do is buy health insurance and not pay the resulting tax.

    So in effect, everyones taxes are raised, even if you dont pay taxes, any credits you would of got would be less because of your insurance tax.

    John “Kennedy” Roberts is known in DC to be a social fellow, eager to be liked by the DC elites, media powers, etc. To some of us, his turncoatism is no surprise; it’s consistent with RNC Progressivism.

    “Left and right” progressives frequently disagree on method and scope, with the former tending to consist more of international globalist factions and the latter being more “Pro-US” in their orientation, but both completely agree on the need to cram down and control the population. ObamaCare helps ensure that the serfs won’t have the capacity to overthrow the feudal progressives once the gig is up on the global debt ponzi scheme. They may scream when they realize the hundreds of trillions were actually redistributed to the progressive elites of both parties, but if they want their health care and food stamps (which will be critical when it collapses), they will shut up and sit down.

    It’s probably too late for the U.S. Romney won’t do much, unless forced to by a tea party driven Congress. Re-nominating progressives like Hatch only ensures this unfortunate outcome. Aggressive Tea Party efforts to advance the right candidates and hold them accountable is probably our last chance to avoid the U.S. fully embracing the Putin “Progressive Oligarchy” model now.

    Oh, the real culprits are the terrible state regulators of medical insurance over the past 50 years or more. I say this as having worked in telecom/utility regulation for 20 years. States have not used their authority to encourage competitive markets with a variety of choices with price and quality variations to consumers. They simply loaded up mandate after mandate of what insurance firms should cover, increasing costs to consumers, creating more inefficient and costly medical service provision. The states have limited the number of firms they would license to insure the public as well. Had states done a good job, the feds would need never look at this, except for medicare stuff.

    The POTUS nominates Supreme Court Justices. The Senate, through their hearings with the nominees, then confirms them. After receiving the seal of Senate approval, the POTUS then appoints them to the SCOTUS.

    The POTUS is to be held no less accountable for Supreme Court picks, but we shouldn’t let the Senate off the hook. They, too, both as Senate and as individual Senators/politicians, should be held accountable as well. This became all too obvious to me when the Senate confirmed Sotomayor, a woman who is plainly yet another racist, Communist-bent, and dumb as a box of rocks as are all racists and Commies. Kagan, also a Commie and a butch lesbian, to boot, shouldn’t have made it past the Senators, either. But Sotomayer…c’mon. I don’t think I know anyone who’s not smarter than her.

    So, if Roberts was plainly a closet socialist from at first sight, then GW Bush owns the nomination…and the Senators who questioned him and held discussions with him during the hearings own Roberts’ Senate confirmation.

    Also, the fact that they use case law now should be illegal. How can a person have their day in court, when the judge is using someone else’s day in court?     According to Chief Justice John Roberts and his liberal colleagues on the Supreme Court, Congress does not have to call a tax a tax in order for it to be a tax. Congress can, in fact, create a penalty instead of a tax, and the President can tell the nation it is not a tax, but the courts can later decide Congress meant otherwise.

    It’s an interesting argument, but one that should have Americans worried. Basically, this is a tax that you have to pay to private companies. For all of the screaming the Right did over single-payer — and for good, outcome-based reasons — at least the money paid by taxpayers would go directly to government [see update II]. The Supreme Court has signed off on what is, in very practical terms, a tax levied by the insurance industry on Americans simply for existing. It’s an amazing, and fearsome, decision that really should have both Right and Left horrified.

    Nevertheless, this is the law of the land. We can now look forward to taxes levied by the auto industry for not having bought a new car in the last seven years, the liquor industry for buying too few bottles of wine to maintain your health, and by the agricultural industry for not buying that damned broccoli after all. We might even have Obama attempt to impose a tax for not buying enough contraception; we can call that the Trojan tax.

    But even if the law survives the Supreme Court and the next election, the clock will be ticking. Recent estimates suggest that the law would cause 11 million people to lose their employer-provided insurance and be forced onto a government-backed insurance plan. That’s a problem because 77 percent of those who now have insurance rate their current coverage as good or excellent. Only 3 percent rate their coverage as poor. For most of the 11 million forced to change their insurance coverage then, it will be received as bad news and create a pool of vocally unhappy voters.

    Additionally, the cost estimates for funding the program are likely to keep going up. Eighty-one percent of voters expect it to cost more than projected, and recent Congressional Budget Office estimates indicate voters are probably right. But it’s not the narrow specifics and cost estimates that guarantee the ultimate demise of the president’s health care plan. It’s the fact that the law runs contrary to basic American values and perceptions.

    This, then, is the third hurdle the law faces: Individual Americans recognize that they have more power as consumers than they do as voters. Their choices in a free market give them more control over the economic world than choosing one politician or another.

    We all know that Britain’s National Healthcare is a total mess. They built hospitals and hired thousands of doctors and nurses before enacting this law just enacted just after WW2. Where are our new hospitals and staff to deal with the millions of people expected to be part of this new system? If anything more people will lose their coverage than gain coverage. It was all about power and never about healthcare.

    That’s wrong for this reason: if the federal mandate is modelled after Romneycare in Massachusetts it is NOT actually a fine or penalty or tax. It’s a tax DEDUCTION much like the deductions we can take for having a child or a mortgage. You CANNOT NOT pay it because the only way to avoid paying the higher tax is to qualify for the deduction. You will get a 1099HC form from your insurance company and you have to enter the number on your tax return. The only way to take the deduction without having a valid 1099HC is to make one up. It would be like claiming a child who doesn’t exist and putting a bogus Social Security number on your return. That’s fraud and perjury and you will go to jail.

    That’s why Congress was able to remove the jail penalty from the bill before it was passed. The only way to get around the tax is to lie on your tax return and THAT’s what they’ll put you in jail for.

Those with no jobs get no taxes, free healthcare, free programs including those to put their kids through college, and freedom from having to work. I am tired of being a slave. At least I still have the freedom to choose to no longer be a slave and quit my job! Now I can relax, spend time with my family, and let Obama take care of me. The scales have tipped.     I like the Aussie Helath Care System the best – Every Working person pays 1.5% of their earnings
    as a Medicare Tax – People can still opt to pay for Private Health Insurance over and above this mandate 1.5% Medicare tax….Medical expenses are minimal in Australia if you opt to pay via Medicare. Medicare comes with restrictions you are put on a waiting list for non-emergency operations and you don’t get to choose your Doctor etc. One medical procedure will not bankrupt you. The US should look and learn.

    Rather than defer to the political process, the Court save the proponents of the legislation from their political decisions, and rewarded a corrupted political process whereby legislation was passed only because it was not sold to the public as a tax, yet saved at the Supreme Court because it was a tax.

    Yet the Chief Justice clothed such activism in terms of restraint. Restraint would have been to allow the legislature to bear the natural consequences of its political decisions, not to rewrite either history or the legislation.

    Roberts was an insider then defending the indefensible policies of the permanent bureaucracy of the Justice Department that was out to thwart Reagan initiatives.

    He’s a backroom “fixer,” and he’s just been rewarded for his underhanded wheeler-dealing with a lifetime nomination to the Supreme Court – and he will not be denied, not by the fat-cat Republicans who dominate the U.S. Senate.

    In another memo to French in 1982, Roberts showed he understood how easy it was to win over conservatives with a simple phrase – a gimmick now employed with great success by President Bush.

    When preparing the attorney general for an interview with the editor of the Conservative Digest, he suggested dropping the phrase “judicial restraint.” That would do the trick.

    Hey, isn’t that the very same phrase that Bush used in announcing his nominee to the world?

    With 51 Senators, GOP can eliminate mandate

    Mitt Romney just now called for immediate entire repeal of Obamacare. Even with a GOP House, GOP Senate, and GOP President, that will be hard, because Dems can and will filibuster a bill, and a 60-vote GOP majority is not in the cards any time soon.

    But repealing the individual mandate takes only 51 votes (50, if a Republican is the vice president). You see, Senators can’t filibuster a bill passed under “budget reconciliation.” Since Chief Justice John Roberts ruled today that Obama’s individual mandate is a tax, Republicans, it seems to me, could simply lower the tax for not having health insurance down to $0.00, as a matter of budget reconciliation.

    Since it’s a tax and not a mandate, there can’t be any penalty for not having health insurance above and beyond the tax. So, voila! No more mandate!

    The Roberts Court basically said Congress was too stupid to recognize that they had passed a tax with ACA.

    What happens if the House [where the bill originated] passes a Resolution explaining to the Roberts Court that they misunderstood Congressional intent…that it is NOT a tax but an individual mandate based on the Commerce Clause and, therefore, unconstitutional even in the eyes of this Court.

    With the United States Supreme Court ruling to uphold the President Barack Hussein Obama health care law, this decision for all purposes President Obama today handed over the November 6, 2012 United States presidential elections to Mitt Romney. Besides the United States of America having a broken economy, this decision by the USSC has for all purposes nailed shut the coffin for the Obama era of the White House.

    Frankly, I was never all that crazy for Mitt Romney, but this decision today pretty much has handed him the White House because it will not only make the United States federal government grow to the point of out-of-control, but it will also bring it much, much closer to an outright dictatorship which I also FEAR.

    Mr. Romney said that first thing as soon as he becomes President he will begin the process to repeal Obamacare. Mr. Romney, I will hold you to it. As the late Ronald Reagan, the 40th President of the United States of America has said, “trust, but verify.”. Mr. Romney I must go along with that statement, in other words DO NOT FORGET what you have said TODAY after the USSC ruling on Obamacare.

    This decision also increases what I have also have been fighting, my increasing cynical view over people who govern and now added to that, to the court system of this country. It increases my distrust.

    Look for that to be the case with more Americans viewing government and the courts in the same light. This is NOT A GOOD DAY FOR AMERICA.

    How IRONIC, just a few days before Independence Day 2012, the birthday of the United States, July 4th.

    Today is also the day to begin to TAKE THIS COUNTRY BACK.

    ‘I’m about to take you on a brief but uncomfortable journey into the land of tin foil hat wearing conspiracies. I’m not going to ask you to believe it, just consider it. Think about it. Think outside the box, and as you do, consider all that has taken place over the last few decades, with particular emphasis on the last five years.

    Listeners to The Hagmann & Hagmann Report and my appearances on other radio programs might recall my source within the Department of Homeland Security making vague references on at least two occasions to the fictional novel written by John Grisham titled The Pelican Brief. The book came out in 1992 and was made into a movie in 1993 starring Julia Roberts and Denzel Washington. There was no clarification and no clarity offered by my source in terms of the reference he made. I was just told to keep that book/movie in mind in the coming weeks and months.

    Given the passage of the Affordable Care Act with Supreme Court Justice John Roberts as the deciding vote, the reference to The Pelican Brief might be making more sense now. Did Roberts appear comfortable in his public pronouncement with regard to “Obamacare?” Did you look into his eyes, the window of one’s soul when he made his announcement? To those with discernment, what did you see?

    Remember, this is the same Supreme Court Justice who “flubbed” the swearing-in of Barack Hussein Obama, requiring a do-over behind the scenes. No video, no audio, no exposure of the “legitimate” oath given to Obama by Roberts. Does anyone outside of that room know what was really said at that private, unprecedented swearing-in ceremony? Like I said, folks, it’s full blown tin-foil hat territory in which we are now treading. But just hang in there with me for a bit longer, and maintain your ability to think outside of the box.

    It is the stated goal of both the communists and the Islamic terrorists to destroy the free, representative republic known as the United States of America. Perhaps more appropriate, to turn the nation into a communist country or see the flag of Islam flying over the White House and all of America, a step toward the oppression of global governance. Read the Communist goals that were read into the Congressional Record in 1963, and look how many of those objectives have already been accomplished and implemented. Is that a conspiracy theory? I contend that anyone with reasonable sensibilities would agree that the objectives and their implementation is based in fact.

    With regard to Islam, look at the charter of the Muslim Brotherhood, and note that the Muslim Brotherhood has infiltrated the U.S. State Department much like the Communists in the McCarthy era. Ten years after 9/11, we now have Islamic representatives influencing and dictating security to the Department of Homeland Security. Could this be purely oversight? I don’t think so.

    Note that the Communist Party USA (CPUSA) is fully backing a second term of Barack Obama, further calling it “imperative” that he is reelected. During Obama’s first term, we’ve seen some of the most overt Marxist and Communist leaning initiatives launched by Obama, with nary a peep from our elected officials on either side of the aisle. How is that possible?
