The Obama Administration asked a federal court today to throw out the lawsuit filed over its mandate to force religious employers to pay for coverage of birth control and abortion drugs.

The Obama administration has asked a federal court to dismiss a lawsuit filed against the Obama administration over its mandate to force religious employers to pay for coverage for birth control and drugs that can cause abortions.

This was its first opportunity to explain to the court and the country why the mandate is not illegal and unconstitutional. The Obama administration did not defend the constitutionality of the mandate, but said the lawsuit should be thrown out because the administration plans to revise the mandate to make it on insurance companies to pay for coverage rather than employers, who will still have to make referrals.

“Plaintiff’s challenge to the preventive services coverage regulations is not fit for judicial review because defendants [Obama and Health and Human Services Secretary Kathleen Sebelius] have indicated that they will propose and finalize changes to the regulations that are intended to accommodate plaintiff’s religious objections to providing contraception coverage,” the Department of Justice (DOJ) wrote in its brief to the Washington, D.C. District Court.

Obama officials claim the mandate does not put forth any “immediate injury” to religious groups.

    A push for repeal of the whole damn thing. Unfortunately, that was supposed to be the Republicans’ job, and by all appearances, it seems they dropped the ball.

  8. insurance companies never provide any services for free, it has never happened in the history of the world. So how is obama going to do what has never been done?
    I know kagen and sotomayer both very wise judges will dismiss this lawsuit if it comes there way.

After Buffett took over the railroad company, he dramatically increased spending on lobbyists. Berkshire spent $1.2 million on lobbyists in 2008, but by 2009 its budget had jumped to $9.8 million, where it more or less remained. Pouring money into lobbying is perhaps the best investment that Buffett could make.

    Obama’s plans to invest heavily in railroads, including a commitment to high-speed rail, put BNSF in a position to benefit handsomely. BNSF already has talked to Seattle officials about leasing or selling its rail lines for an intercity project, and that’s just a start. A map of BNSF lines around the country overlaps nicely with the government’s proposed high-speed rail lines, from Seattle to Florida, California to the Northeast. Buffett is geographically and strategically positioned to profit from those government-funded rail systems, should they be built.

    The 2009 stimulus package includes $48 billion (of the total $787 billion) for infrastructure improvement, a chunk of which is headed for railroads. How much will BNSF benefit? It’s hard to calculate. Type “BNSF” on the Recovery.gov website, which tracks grants, subsidized loans, and contracts signed under the stimulus, and you find 1,800 entries, including everything from a $36 million grant from the Department of Homeland Security to money from the Environmental Protection Agency.

  12. this is part of obama’s core belief so he’s not going to have a come to Jesus moment. he’ll suck his teeth and then look for another angle. probably just me but the idea that he can make the Catholic church bend to his dictates must have had him saliviating. a learning eperience for the rubes and maybe a test of faith for the church.

  14. changing our moral authority to obama and co. – i think not. look for the subtle punishments. yesterday there was an article about a food pantry run by St Vincent De Paul……planned parenthood wanted to make a donation but wanted the organization to pick up at their facility….they were told that someone from pp would have to drop off the donations. they weren’t interested in photo ops and other issues. there’s another article a bit more specific with st. vincents position but they were questioned about their view…….

  15. Uh, Obama does realize this is an election year, right? And he does realize that Catholics are a huge voting block, right? One that could tip a toss-up state like PA, right? Oh wait, he obviously doesn’t because anyone with even the slimmest grasp of political instincts would know just to back off and hope this story fades from the public consciousness. Instead, he keeps reminding people of his screw-up and proceeds to make it worse.

  16. We must fight this in the courts, in Congress, but most of all, we must vote the perpetrators out this November. If we lose , more and more such mandates will be handed out. As time passes, we will look back and wonder why we didn’t throw our whole hearts into stopping OBAMACARE’s implementation. It will end our freedom and ruin our economy.
