You can mine all you want… You just have to use a pick ax and can only feed your mule weed-free hay.

The liberal 10th Circuit Court of Appeals decided this week to allow mining at a national forest in Montana – But only if you use pick axes and only if your mules are fed weed-free hay.

Last week environmental groups hailed a decision from the 10th Circuit Court of Appeals that upheld a law prohibiting roads on nearly 50 million acres of national forest. Lawyers for the Colorado and Wyoming Mining Associations contend that the 2001 Roadless Area Conservation Rule violated the law. Previous conflicting federal court rulings have both upheld and overturned the road-building ban.

Jane Danowitz, director of the Pew Environmental Group’s U.S. public lands program acknowledges that the roadless rule blocks “logging, drilling and industrial development.”

Expressing disappointment with the decision, Stuart Sanderson, President of the Colorado Mining Association said, “The decision does not reflect a practical understanding of the impact that the rule will have upon mining jobs or access to needed minerals here in Colorado and the U.S. It is important to develop high quality coal and other mineral reserves, both to ensure our nation’s energy security and reduce our dependence on minerals produced in other countries.”

How does this roadless decision impact mining and jobs?

In Montana’s Finley Basin there are known tungsten deposits. An Australian company wanted to bring revenue and jobs to the state by developing the resource. While the property was successfully drilled and recognized by Union Carbide in the seventies, it is now about 200 yards inside a roadless study area. The Forest Service was willing to offer a conditional drilling permit. Among the conditions were these requirements:

  •          The drill sites must be cleared using hand tools,
  •          The drilling equipment and fuel must be transported to the site by a team of pack mules,
  •          The mules must be fed certified weed-free hay, and
  •          Drill site and trail reclamation must be done using hand tools.

The company gave up.

  3. I am as far to the right as anyone with one exception, the environment; and no, I don’t mean the Global Warming baloney. As an avid outdoorsman, I am sick and tired of seeing the landscape needlessly torn up and subsequently polluted when other means are available for extracting resources or even alternatives for what ever the need be. Not to mention, going miles into the untracked/untamed wilderness only to see platic bottles, bags and assorted other trash littering the landscape.

    I am a champion of perserving as much wilderness/waterfront property as we can from development, etc. We simply have enough land already in use or that can be rehabed for what ever reason, including many mining areas closed by previous lib action, etc. Color me lib here, but I support the court (except for the ridiculous ‘weed free’ hay bit; typical take-it-too-far lib ruling)

  6. I know I get redundant when stuff like this comes up, but I think it needs to be said.

    What should happen now is for the states of Montana and Wyoming to assure mining operations that they have the full support of the state from an administrative perspective as well as from a law enforcement perspective, and that the federal government will not be allowed to persecute or prosecute them. Then the mining operations should go ahead and start mining under the protection of their state government, as if the federal government has no authority over what happens in their state.

    Force the issue of states rights by states partnering with businesses in defiance of federal bureaucratic and judicial edicts that are not strictly underpinned by federal legislation. Force the feds to either justify laws that do not originate in congress, or move tanks into sovereign states in order to enforce bureaucratic edicts and judicial usurpations.

Large scale manufacturing, the kind that generates lot of employees for unions to represent, lots of deep pockets for lawyers to pillage, lots of property taxes for politicians, lots of employment taxes to mismanage, really good medical insurance coverage to exploit….take planning periods that exceed the Washington turn over in political party in control. The US cannot make the investment in quality jobs because scores of bureaucrats can shut down the progress for no more reason than to refuse to talk to there coworker.     There is a large natural resource disaster taking place across the western United States called the pine beetle. The feds in their management have no plan to address the deforestation of Federal lands. There is no permit they can issue to the beetles to tell them to stop chewing. They are not equipped with the planning skills to develop pesticides or harvest strategies. Private business recognizes the pine beetle as protected by the bureaucratic ineptitude and not a valid area of work. The environmentalists are responsible for this diasaster

No, what needs to be done is come up with a law that says liberal environmentalists violate the right of a business to freely pursue lawful business practice that provides natural resources to the nation at minimal damage to the environment. If the liberals can’t disprove that mining company is going to do that, and is going into the public land just to screw it up with sloppy mining practices, then the court has to allow the mining company to be able to go anywhere it wants. These “roadless” laws are unconstitutional because they prohibit a lawful company from pursuing a legal business venture. But, it’s ridiculous to sue a company that environmentalists believe are messing up the environment, because they couldn’t prove the mining company wasn’t going to do the mining in a irresponsible manner. If they were they would have to be allowed to do whatever they want.

    This is the sort of liberalism that needs to be turned against liberals by finding something they do and force them to do it manually and see how they like it. People who are a lot smarter than I am would know what those things are because I don’t know what liberals do that is like everyone else that you could force them to do manually, and if you did they would have to stop doing it because it would be to hard to do that way just like building roads with pick axes would be to hard and labor intensive at to high a cost to build a road that would take years to build by hand. That’s what liberals want and that is for all of us go back to horse and buggy days in everything while they live it up in any and all high tech manner they choose.

    Here’s something else to face. The Republicans (my affiliation) are doing a poor job of messaging and they are making the election of Obama more and more probable every day.

    Every time Obama gets a chance to speak he gets his points across and he knocks the Republicans, however absurd he may be. Obama also has such a sophisticated new media campaign. We, on the other hand, have leaders who can hardly write with chalk on the blackboard and whenever a prominent Republican speaks, the message is either too complicated or vague and they never stick it to Obama. They are organized and focused. We are divided and vague.

    My point is this, we should immediately re-assess what we re doing. We can whine all day about the absurd mining restrictions in Montana, but calling people’s attention to such non-stories like this is detracting us from what we should be doing.

    We should be demanding that the Republican party get its act together with respect to messaging and that they should stop their political shenanigans like this past week’s disaster. We can criticize Obama all we want, but until we get organized, put out a consistent and simple message and stop our whining – we are simply opening the door for Obama’s re-election.

    I’ve had to buy the certified weed free hay on my elk hunting trips out west for at least the last decade. It’s a pain in the rump, but take one trip say to Alabama and see all the kudzu grass down there and you can appreciate why they wouldn’t want an obnoxious weed in a pristine wilderness area. Where we hunt in the wilderness area of Colorado, Montana, and Wyoming, you also can’t use ANY motorized equipment. 4-Wheelers, generators, chainsaws, ANYTHING. Hence is why we take horses and mules to pack in, pack out, and ride so you don’t have to do all the walking. And yes, they do have folks that check for the use of certified only hay! Just ask my cousin all about when he decided to try to cheat the system and brought some hay up from Texas on one of his hunting trips!

    Most of you that have been around awhile know, I am NO liberal, and I’m here to tell you I’m no Environmentalist, but this ruling is nothing new.

    Leftists with a practical understanding–Never going to happen. Every thing they do is designed to get more union employees on government payrolls. Every day there are leftists complaining about the cost of retired military veterans. Yet a few months ago we learned of rabbit farmers facing 4 million dollars fines for some violation of the rabbit laws. We learned there are US federal government employees who do nothing but drive around looking for unlicensed rabbits. Now we learn that government employees drive around making sure that mules only eat weed free hay. What few American workers who actually work are going to be funding the retirement of government workers who have chased rabbits and checked hay for weeds all their careers. Can we as a nation afford this?

    My last pertains to what I really think is afoot.

    The Holodomor happened for the same reasons as this, and with the same mind-numbing, intentionally and bombastically surreal rulings like this one. One after another and another and another for years, until the folks in charge — the regulation-writing agencies who write de-facto laws on their own with no oversight whatsoever all day long — realize that they can starve tens of millions of people with the stroke of a pen, sitting at a comfy desk.

    This is what happens when we have so many of these regulatory agencies. They can write, and enforce, any regulation they write. In essence, regulations are LAWS. We have TENS of thousands of bureaucrats nationwide just writing rules and regulations, with no oversight and a complete collusion with the judiciary, as I said, ALL DAY LONG.

    I thought laws were written by Congress.

    Oh, yeah. That was in the United States of America, Democratic Constitutional Republic.
