Gibson Guitar CEO: “Obama Justice Department Wants Us to Just Shut Our Doors & Go Away”

Henry Juszkiewicz, the CEO of Gibson Guitars, Inc. was on The Dana Loesch Show this afternoon. Gibson is under attack by the the Obama Justice Department for accusations that the company broke American Indian laws.

Juszkiewiz said the government suggested that the company’s use of unfinished wood from India is illegal, not because of U.S. law, but because of the Justice Department’s interpretation of a law in India. The Holder Justice Department raided at least two Gibson manufacturing plants this week forcing hundreds of workers off their jobs. Juszkiewiz says the company lost a million dollars this week.

Finally, Henry Juszkiewicz told Dana, “The Obama Justice Department wants us to just shut our doors and go away.” He says he will continue to fight for the Gibson company and its workers.

Juszkiewicz held a press conference yesterday in front of the Gibson headquarters.

The Obama Justice Department confiscated over $500,000 in materials back in 2009. Gibson is going to court on Monday to discuss a previous request for the government to return the property.

Peavey is another guitar and electronics company, located in the
right-to-work state of Mississippi.

Since 2009, Peavey has been the target of multiple lawsuits filed by
a competitor, MUSIC Group, which alleges that Peavy products fail to
meet federal safety and emissions standards.

    There has to be something more to it, because this story only reinforces that the Obama administration destroys jobs and is a detriment to our economy. Can the WH be this clueless?

    OK….I’m a boutique guitar builder….I guess they will be coming for me next!….I have imported wood into the US in large quantities. An import permit from the US Dept of Ag is required, along with fumigation certificates from the seller/exporter. So, my question is…..IF this wood is illegal, why wasn’t it seized by customs at the port of entry?

    The government’s position is, that is the law of the land in Madagascar and they are saying that is the law of the land in India. That is not the case. The fact is, we have affidavits from numerous government officials – and this court case, specifically now, is forMadagascar wood. We have affidavits from virtually every govt official saying that it is legal, that their definition of what is legal is a fingerboard blank and its been exported within every certification that is necessary. They picked Tenn. over all the other union-unfriendly Southern states because of tax incentives offered to them, but they moved because of labor.” They moved in 1981. People all over the nation could impact this nonsense if when such travesties happen in their towns. As much as we hate the unions they at least have the stones to stand up for what they want by organizing etc. But most on the Right just sit in the comfort of their homes and mumble to themselves. One of the most decadent travesty on this nation was the Kevin Jennings appointment as the Safe School CZAR, I had thought mothers nation wide would have come to the forefront on such a disgusting move by WTF, but no hardly a peep. Pretty well established Americans no longer have the backbone to defend their children let alone the nation.     The wood wasn’t seized by customs because the intent of the regime is to shut down private industry, especially those with a management who support the GOP or conservative issues. Eric the Red and his DOJ is a rogue operation, as is the rest of the regime. They are, from the top down, a clear and present danger to the American people.

    Madagascar us one of the poorest countries I’n the world and there has been political unrest for the past two years. The species I’d wood endemic to that island has been depleted from other sources, and is now being depleted there due yo illegal logging. Malagasy Rosewood is very rare and used for these musical instruments. Ebony also grows there Both trees are slow growing and may take 300 yes to reach maturity.
    Most likely, Madagascar officials have notified DOJ.

Protecting both plants and wildlife by creating civil and criminal penalties for a wide array of violations, the Act most notably prohibits trade in wildlife, fish, and plants that have been illegally taken, transported or sold. The law was signed into law by President William McKinley on May 25, 1900, and is still in effect, although it has been amended several times.[1]”

    So, the Lacey Act was conceived by conservationist and enlightened people who knew that certain “natural resources” were depleting other countries, and using slave labor. Since Gibson was already raided for this in 2009, the conclusion seems to be that they turned a blind eye to the slave Madagascar labor and the sending of the national treasure for the embellishment of the coffers of a couple of “timber barons” and Gibson’s new “revolutionary” guitar, which will be be smashed to pieces by our heavy metal guitarists.

    I think everyone us overreacting. Gibson broke a US law, the Lacey Act, which is one of the first conservationist laws. The cash crop for Madagascar used to be vanilla which was decimated and caused this spree of illegal logging, which Gibson tried to hide by having it shipped through Germany. It’s the impoverished people of Madagascar who are getting screwed, by the Madagascar barons in complicity with Gibson.

    Juszkiewicz is on the Rainforest Stewardship Council, and has worked to preserve endangered and rare woods (he has stepped down since the 2009 raid to deal with the allegations). Gibson has documentation that all of the Madagascar wood (the subject of the 2009 raid) was approved for export by that country’s officials.

    The latest raid involves woods from India. I have nothing on the details, but the Indian government does not see a violation and played no role in the raid or inspiring it.

(If the same wood from the same tree was finished by Indian workers, the material would be legal.) This action was taken without the support and consent of the government in India.” There is a lot of ambiguity on just what has happen, but given WTF and holders favored treatment for their people nothing should be overlooked. If Holder has so much time on his hands why not help secure the border?

Gibson deserves his day in court so he can expose the fact that the Feds have no proof of wrongdoing.     We are told that the several federal agencies who regulate and inspect wood being imported are competent enough to not only be given a monopoly on doing the job, but we give them guns too. These people have the whole government, including the courts and those running our prisons that they are even competent enough to throw people in jail who violate their rules and procedures.

    We are also told that the Justice Department is competent enough at enforcing the entire Code of Federal Regulations and the US Code that we not only give them a monopoly on that job, but the courts take it very seriously when they arrest someone and charge him with a crime.

    In the case of the Gibson, we have dueling competencies. No wonder we are confused. Gibson’s actions had passed the muster of the competent agency in control of inspecting and approving of the wood being imported, but the Justice Department, in its awe-inspiring competency, determines that very same wood violates the law and regulations being enforce by the first group of Master Competents. Do we get to shop around to find a Competent Authority that we agree with? No, we can only suffer after the fact when Competent Authority ‘J’ disagrees with Competent Authority ‘C’. And in the process we incur a million dollars in legal fees and risk being thrown in jail.

    No wonder nobody is hiring. They dare not start anything new lest we get another expensive and dangerous exercise in Dueling Competencies.

    One of the world’s best guitar maker and employer. Peavey has a real ___ for Gibson. Competition is what has made this country great. We have seen what dictators have done in other nations. They are all falling down. Seems in November of 2012 ours will too.

    And happy days are here again. When this administration has been shown the door the investigations will be coming. The outrageous lawsuits and tying up the courts with complete and utter nonsense. I suppose all those Federal Attorneys will their little appointments are so hard at work.

    Madagascar is not india. What upsets me is Gibson knowingly exploiting the slave labor if Madagascar and that is what we should be focused on.
    No one here has done a bit of research to understand that the of Madagascar went thrpough a military coup in 2009.
    Gibson tried to sneak the contraband into the country by having it shipped through Germany. That’s why it wasn’t picked up at customs.

    In a nation where making money, creation of jobs, influx of wealth and economy growing, we are witnessing the end of this. We are living through a time when it is very difficult for Americans to make the same living they once did and it is getting worse by the day.

    Washington doesn’t have the answers. Washington is making it worse.

    Even those businesses that have flourished are slowing things down. The uncertainty and stories like this and Boeing are hurtful for America to hear.

    One thing is for sure, Immelt should be fired but he has done so much damage now, we may not recover from the secrets China as received and in my opinion it is treasonous.

    America is slipping away because of actions the DOJ is taking in the Gibson situation. It is unthinkable and this is our leader taking jobs and forcing Gibson’s hand.

    No pun intended. A real business that is having to defend itself in these times.

FSC Controlled Wood standards require, among other things, that the wood not be illegally harvested and not be harvested in violation of traditional and civil rights. See for more information.     Want to know the real reason that Gibson was targeted? Notice that it’s a right to work non-union company. Obama lost the support of the unions last week when the president of the AFL-CIO announced that instead of supporting automatically the Democrat party that they were going to spend their union money building up their own base and this is one way that Obama’s working to get it back.

    Why is the DOJ “enforcing” India’s laws?
    Did we sign a treaty with India that requires us to follow their laws in our country?
    Did India request this intervention?

    It does seem scary that the only two guitar manufacturers being targeted are located in right-to-work states; that makes the whole issue so transparent, since all the manufacturers mentioned use ebony in some of their guitars. How unlikely is it that Gibson would be the only one to purchase so-called illegal wood?

    The DOJ should turn its eyes upon itself; that is where the real problems are. Especially that arrogant Attorney General.

    What you all fail to realize is that the Lacey Act was last amended and enacted December 15, 2008, 36 days before Obama took office. The law is there to prevent corporations purchasing and using illegal materials. The other instrument companies mentioned are in full compliance with the law. If Gibson did not comply with the law, then it is their fault, not the DOJ. Congress enacted the legislation and the Bush Administration signed it into law! This law is over 100 years old and has been modified numerous times over the years. Some of your comments are basically asking our government to prosecute people in other countries (gun runners) but that continues to be an issue in another country. This is a corporation allegedly committing illegal acts in the US. If they are not committing a crime, they will be exonerated and all property returned. This is how it works. Innocent until proven guilty. You’re all behaving as if they have already been proven guilty. Now I love Gibson as much as any musician, but I believe in the laws and Constitution of this great country, and believe justice will prevail. If you or I had done such things, we’d have to defend ourselves just the same. The DOJ does not work alone, they must use the courts and have evidence of a crime before acting, otherwise they would not be able to “raid” the factory. I’d like to hear the full facts before making judgement.

    Also, remember, this is an American law, not an Indian law enacted in 1900!

    Having nothing to do with politics or at least nothing to do with US politics, I for one am glad to see karma sting a company that deserves every bit of this. Gibson has been a sue happy force that has destroyed competition by dragging any guitar maker that makes a single cutaway into court. Their PRS lawsuit a few years backs was unwarranted and a pathetic attempt to squash a company that makes more consistent guitars.

That fuse was lit back in the 1970s when Carter signed into law The Community Reinvestment Act (CRA, Pub.L. 95-128, title VIII of the Housing and Community Development Act of 1977, 91 Stat. 1147, 12 U.S.C. § 2901 et seq.). This law put pressure on lenders to give out loans to low-income families because for whatever reason you libs think just because we’re Americans we’re entitled to home-ownership, healthcare, well-paying jobs, etc.

    That same little flame on its way to the powder keg accelerated in the 1990s when Clinton initiated regulation reform of the act to make it less burdensome for people to get their loans. Clinton wanted to make it easier to get a loan dependent upon where you lived (i.e. the inner cities and poor rural areas), not whether you could pay back the money you owed.

    Chris Dodd and Barney Frank also played their precious little parts with their criminal activities and cover-ups regarding sub-prime mortgage controversies and allowing Fannie and Freddie to go wild, unchecked.

    Democrats also obstructed legislation against these GSEs (Fannie and Freddie) while also taking political contributions from them, Obama being the second-highest recipient.
