When the Environmental Protection Agency said in late June that it would force Western coal-fired power plants to install haze-reducing pollution-control equipment at a cost of $1.5 billion a year, it said it had to in order to settle a lawsuit by environmental groups.

One organization involved in the suit, the Environmental Defense Fund, has a long history of taking the EPA to court. In fact, a cursory review finds almost half a dozen cases in the past 10 years.

The odd thing is that the EPA, in turn, has handed EDF $2.76 million in grants over that same period, according to an IBD review of the agency’s grant database.

This strange relationship goes well beyond EDF. Indeed, several environmental groups that have received millions in EPA grants regularly file suit against that same agency. A dozen green groups were responsible for more than 3,000 suits against the EPA and other government agencies over the past decade, according to a study by the Wyoming-based Budd-Falen Law Offices.

  5. This keeps the EPA bureaucrats busy – deciding how to dole out grant money and defending itself from lawsuits. This is the nature of the federal government. The stupidity is just a means to make it appear that centralized control is a necessity. If you haven’t noticed, the game is now on for real; put your hand out to get your piece of the action while the fed is still in business creating dollars out of nothing.

  7. These suits have been a standard practice when dealing with the DOI, USDA, Corps of Engineers, NOAA, and NASA and numerous agencies within these departments. The NRDC, EDF, Sierra Club via their so-called public interest law firms, and numerous so-called citizens groups have been short circuiting Congress and th executive branch for decades with sweetheart litigation and settlements that become agency policy that implements their radical environmental agendas.

    Worse, when they are the prevailing party or win via settlements, they recover reasonable attorneys and litigation expenses. These outcomes are made possible by the citizen suits provisions of the laws, regulations and agency actions that are successfully challenged. The citizen suits provisions operate as bounty hunter payments.

    This is all made possible by effective lobbying by environmental organizations that started in the late 1960s. It is the worst sort of political corruption that flows from conflicts of interests and sell outs by crooked politicians. Government employee unions benefit from the same type of unlawful and immoral relationships with elected officials.

  11. SO why are the budget talks being labelled as “cutting social security” when they should be “100% defunding EPA, Dept of Education and HUD?”

    Everyone ELSE is being thrown out of work, so they don’t need two weeks notice, they’ll take too much stuff. Just change the passcodes so when tomorrow’s rosy-fingered dawn arrives, no one can get into the building. Then put it up for sale.

  16. The allegations about sweetheart litigation, if true, are serious. The only way that something like this can happen is when the word never gets out to the rest of us.

    Although Congress has oversight authority, they tend to focus on the crisis du jour, and may not notice.

    Also, in a Federal lawsuit, one fundamental requirement is for the parties-in-suit to identify all the real parties in interest — that is, any entity that has a financial interest in one of the parties, or would be affected by the outcome. It’s one of those procedural things designed to bring conflicts of interest out in the open.

  22. Just as our current economic crisis has its roots in the Community Reinvestment Act, this job-killing racket is the result of the Clean Air and Clean Water Acts. In addition to closing down the EPA, both of these laws should be repealed immediately and the responsibility handed over to the states who have their own environmental agencies.

    I’m a strict Constitutionalist when it comes to the EPA. Their policies are responsible for the transformation of California’s Central Valley from lush farmland to a dustbowl, among many other actions that place the welfare of animals ahead of the people. How is that acting for the public good?
