Eric Holder's Radical Far Left Attorney Claimed Khalid Sheikh Mohammad Was Tortured; Pushed to Throw Out His Guilty Plea

Jennifer Daskal is a radical far left American lawyer who serves as senior counsel for Human Rights Watch, and focuses on issues of terrorism, criminal law and immigration. She is also currently a political hire at Eric Holder’s Department of Justice, which is seeking to prosecute terror suspects through the criminal justice system instead of through military tribunals.
In 2008, Daskal claimed that Khalid Sheikh Mohammad was tortured and recommended that his guilty plea be thrown out of court. Now this radical is working for the Obama Administration.
It figures.
Human Rights Watch reported:
Khalid Sheikh Mohammed and four others announced that they plan to plead guilty to conspiring in the September 11 attacks and related crimes at a hearing before US military commissions at Guantanamo today. All five defendants face the death penalty.
“What should have been a major victory in holding the 9/11 defendants accountable for terrible crimes has been tainted by torture and an unfair military commissions process,” said Jennifer Daskal, senior counterterrorism counsel at Human Rights Watch. “These five men are known to have been mistreated and tortured during their years in CIA custody, including the acknowledged waterboarding of Khalid Sheikh Mohammed.”
Prior to their transfer to the US military detention facilities at Guantanamo Bay in 2006, all five defendants were held for years in secret CIA detention. Earlier this year, CIA Director Gen. Michael Hayden acknowledged that Khalid Sheikh Mohammed had been subjected to “waterboarding” – a form of mock drowning that has been prosecuted as torture by the United States for more than 100 years. Other defendants are believed to have been subjected to other abusive interrogation methods such as extended sleep deprivation, the use of painful stress positions, and forced nudity, while in CIA custody.
Under the rules of the military commissions, a judge cannot accept a guilty plea unless he determines that the plea is voluntary and free of coercion.
Of course, the fact that such a twisted radical is serving in the Holder Justice Department, surprises no one.
More… At least 9 Holder Justice officials have previously represented terrorists.

There was a very satisfying moment on last night’s episode of “24.” The Renee character is being grilled by a Justice Dep’t. flunkette for having “murdered” a Russian gangster who had physically attacked Renee. Jack Bauer bursts into the interrogation room, grabs the lawyerette by the throat and slams her against the wall while reading her the riot act.

In a perfect world, if they move to have the cases thrown out for ANY reason, these Leftist, America-hating attorneys would have to serve the sentences that would have been handed down to the terrorists, and the terrorists would be handed back over to the military to be tried in military tribunals. Sad thing is, she’s kinda right (albiet for all the wrong reasons). If KSM is to be given a civilian trial, with all the rights of a civilian detainee… the case SHOULD be thrown out on civil-rigfhts grounds, as KSM was NOT treated at any point as if he had civil rights. Otherwise, we end up with a ‘Terrorism Court’ where guilty verdicts are predetermined and civil rights are excluded… and I don’ think anyone wants to see such in the hands of the Obamanauts.
All of this is why KSM- and all of the detainees at Gitmo- should have been handled by military courts-martial, as the Geneva Conventions allow for, years ago.

But judging by his behavior so far in this matter, I suspect he is drawing the definition very narrowly to exclude many others who may not have been directly involved with court cases or amicus briefs, but who have advocated the same things as those “officially” tied to terrorists.
This isn’t over. Grassley is royally perturbed at Holder’s disingenuousness, and is determined to get to the truth.

Let’s just hope any decisions in such a court of law will not be used as precedent in any other criminal court. I don’t think foreign terrorists should be tried in criminal courts or military tribunals. They should be judged by a separate code of law; no Miranda rights, no 5th amendment rights, no adversarial court model, etc.

Our military should take notice of things like this. They need to know that our enemies are now running our country and they will and have defended our enemies while going after our own Intelligence Agency and soldiers. When our military captures a terrorist they should immediately interrogate them for whatever info they can get using whatever means necessary and then kill them so Obama and Holder can’t defend them. Just say they were shot trying to escape and that you never had a chance to interrogate them, then use the actual actionable info you did obtain before Obama can prevent you from using it and covering his terrorist allies escape.
