How is this happening in America?

Dominic Pezzola, a Marine Corp. veteran and defendant in the Proud Boys Seditious Conspiracy Trial, has not had access to or seen an iota of his own defense discovery AND IT IS DAY THREE OF HIS FEDERAL TRIAL. Pezzola has been locked up in unconstitutional pre-trial detention since January 15th, 2021.

He is literally watching the video for the first time in the court room with the jury!

We are here at the Proud Boys trial in Washington, D.C. and witnessing the dystopic Government making scapegoats out of a drinking fraternity and blaming them for everything that happened on January 6th.

Yesterday we witnessed Roger Roots, a new addition to Pezzola’s legal team, plead with District Judge Timothy J. Kelly to hand his client a computer in the court room so Pezzola could take it back to jail after day three of court and access his own discovery for the first time in two years.

The judge said NO. 

Roots then asked the Judge to intervene with Alexandria Detention Center and the Marshals so he could get the discovery to his client, and again the judge did not want to do so.

Pezzola has been bounced from jail to jail- all of them denying him his basic right to view his own discovery. According to attorneys, the judge has the power to supersede the jail’s unconstitutional policy and could order them to accept the laptop.

“I do not want to override the Marshalls or Jail,” Judge Kelly told the attorneys. “Go back to the jail tomorrow and try again.”

Apparently Judge Kelly has more regards for the jail’s arbitrary and capricious rules than the Sixth Amendment of the Constitution. Hopefully Kelly will be investigated by the new GOP “Weaponization of the Government” Select Committee aimed at the Department of Justice and government agencies.

Federal Judge Timothy J. Kelly, sadly a Trump-appointed judge, is also the judge that ruled that the White House had to restore CNN’s fake news persona Jim Acosta’s press pass. 

Pezzola has not yet seen an iota of his own discovery going into his trial and is therefore unable to assist in his own defense trial- which is A CONSTITUTIONAL RIGHT!

How did Judge Kelly let this go to trial??!!?

According to co-counsel Steve Metcalf- “We made an oral application to have the judge order the U.S. Marshals or Alexandria Detention Center to accept this laptop of Pezzola’s discovery that we presented to the court today- because after five mis-attempts we cannot get Alexandria Jail to accept this laptop so he can view his discovery.”

According to Metcalf, the legal team has been fighting to get Pezzola his discovery for a year and a half- to no avail. Yesterday was just the most recent attempt at what has been like what attorney Metcalf describes as “going around in a hamster wheel”.

“There is a hard drive that I spent thousands of dollars putting together, that has thousands of video, images and documents on there that Dominic needs to review for his defense, it’s that simple,” said Metcalf. “The judge said he is uncomfortable in making an order that makes Alexandria Jail go against their policy.”

The Italian-American Golden Gloves Boxer has been locked up pre-trial away for 732 days and counting- OVER TWO YEARS NOW. He is currently being held in solitary confinement in Alexandria State Penitentiary for the duration of his trial.

Pezzola’s new attorney Roger Roots spoke to us today about Pezzola’s discovery situation. He said:

“This has been an ongoing problem with the Alexandria Jail where these inmates are being held. We are trying to get their discovery to them. Mr. Pezzola has a massive amount of discovery on a large external hard drive. We tried to get it to him over two weeks ago…I believe it was in December, actually. The jail makes all kinds of security issues and arguments. We have been stopped from delivering the discovery. I have been stopped from doing a legal visit on one occasion on the grounds that I have a drivers license from one state and a bar card from another state. The staff at the jail always say things such as you need to get approval from the Superintendent so and so at the jail and he is available Monday through Friday 8 –  5. And of course we are in trial Monday through Friday 8 – 5. Today I brought this to court (laptop). After several attempts and Uber trips we got the discovery in external hard drive form to the jail and it is sitting there at the jail but they say we need to provide a brand new laptop for Mr. Pezzola to review the discovery in the jail. So we ordered a brand new laptop, here it is in a box. Never been opened. We were turned away Saturday night again, come back and get approval from Superintendent so and so Monday through Friday, 8 through 5, the very time that we are in court. So I literally brought this laptop TO THE TRIAL TODAY… I asked the federal judge if we could just hand it to them in court. He says no, I believe he did say go to the jail again at 8 AM tomorrow morning and hand it to the jail again. So we will take one more Uber trip over there, we are talking two weeks of struggle, just to get Mr. Pezzola his discovery.”

“District Judge Timothy J. Kelly seems at times like part of the prosecution team rather than a fair judge as he constantly sides with the Government and overrules the Defense team,” said Tina Ryan of Citizens Against Political Persecution. “He could care less about Dominic Pezzola’s due process rights. This is a mistrial on so many levels.”

Nick Smith, the attorney for Pezzola’s co-defendant Ethan Nordean, also made a Motion yesterday and presented a compelling argument to the judge to grant the Proud Boys pre-trial release. According to Smith, this would be the only way the men could fairly view their own discovery and take part in their own defense as the jail was not cooperating in letting them view their discovery. Smith said the government has not given a good reason as why the defendants could not be released pre-trial, while people charged with way worse crimes are out on bail.

Off course this motion was denied by Judge Kelly and the defendants were sent back to their squalid cells .
