US Appeals Court Rules Trump’s EO Threatening to Withhold Funding From Sanctuary Cities ‘Unconstitutional’

A US Appeals court ruled Wednesday that President Trump’s executive order threatening to withholding funding from sanctuary cities that refuse to cooperate with immigration officials is ‘unconstitutional.’

Fox News reported:

“Absent congressional authorization, the administration may not redistribute or withhold properly appropriated funds in order to effectuate its own policy goals,” Chief Judge Sidney Thomas wrote for the majority.

In a 2-1 ruling, Thomas also said he’s sending back the case back to the lower court because there wasn’t enough evidence to support a nationwide ban on Trump’s executive order. The case will receive more hearings on the nationwide ban question.

In November, U.S. District Judge William Orrick issued an injunction to permanently block the President Trump’s executive order to cut off funding to sanctuary cities. The judge said the president didn’t have the authority to attach new conditions to spending approved by Congress, adding that the president’s efforts also violated the separation of power doctrines.

The ruling came in lawsuits filed by two California counties — San Francisco and Santa Clara.

President Trump promised to crackdown on illegal immigration on the campaign trail.

According to a recent Gallup poll, illegal immigration is one of the most important issues for Americans today.

Leftists care more about illegal aliens than they do law abiding, tax paying American citizens.


Sanctuary cities put Americans in grave danger as they allow MS-13 killers, illegal alien rapists and Mexican drug cartel members to be shielded from extra scrutiny by immigration authorities.

RINOs and Democrats are also working together to block the border wall from being built by withholding funding.
