A federal jury convicted David Kernell, a college student who broke into Sarah Palin’s email account, of unauthorized access to a computer and obstruction of justice. The young Obama supporter was sentenced to a year in prison in November. The judge recommended that Kernell serve his time in a halfway house. Sadly, that didn’t work out.
Sarah Palin testified against Kernell, the son of a prominent liberal politician from Tennessee, at the trial.

David Kernell, the son of liberal Tennessee State Representative Mike Kernell was indicted in October 2008 by a federal grand jury in Knoxville, Tennessee., for intentionally accessing without authorization the e-mail account of Alaska Governor Sarah Palin.
The Federal Bureau of Prisons rejected a federal judge’s recommendation that David Kernell be housed at a Magnolia Avenue halfway house instead of a prison.

A former University of Tennessee student convicted of illegally accessing Sarah Palin’s private e-mail account is too smart and too loved to rate a bed in a Knoxville halfway house.
So says the Federal Bureau of Prisons in a rare public explanation of why the agency rejected a federal judge’s recommendation that David Kernell be housed at a Magnolia Avenue halfway house instead of a prison.
BOP Chief Jose Santana wrote in a letter to U.S. District Judge Thomas Phillips that he could not honor the judge’s request that Kernell spend his sentence of one day shy of a year at the Midway Rehabilitation Center because there are too many needier felons waiting in line.
“Our agency contracts (halfway house) bed space for inmates who have a greater need … such as those with limited job skills/resources and family and community support,” Santana wrote. “Mr. Kernell has attended three years of college and has the support of his family.”
The bureau instead sent Kernell, 22, to a minimum-security facility in Ashland, Ky.
In his first public comments on the BOP’s decision, defense attorney Wade Davies said Thursday that he found the explanation lacking.
Most Likely Scenario – The prison will be full of democrats and Obama supporters who will treat him like a hero.

I suspect, however, that this decision is part of a larger plan, one that will have Kernell back home in a couple of months instead of staying in a halfway house for a day short of a year. Crappy halfway house filled with peasants for 364 days? Or…A couple of months in minimum security prison then out on parole or just out? 364 days? A couple of months? I’d definitely go with the couple of months at minimum security prison…if I was a loser criminal, that is.

I never knew a criminal who couldn’t aquire a firearm. Chicago has the most strict gun laws of any city in the United States. I have had deputy sheriffs at the Cook County Court house tell me the were afraid to be around the court house after dark – and they had loaded .45′s.

“Unauthorized access to a computer” is BS. He didn’t access a computer. He accessed an account that wasn’t his. Essentially it’s unauthorized access to software.
Also, he didn’t hack anything. What he managed to do has to be partly blamed on Sarah Palin as well. She used real life info for the most secure parts, which is… utterly STUPID.

A felony conviction would seem to limit his future choices. No Federal job for him. He couldn’t get a security clearance. Probably couldn’t get a teacher’s certification because of a felony conviction.
I suspect he’s had a history of questionable activites and he’s always been able to skate because of Daddy’s political pull. Didn’t work this time.
Despite this, rape is not an appropriate punishment for his act. People shouldn’t make jokes about that.

I live a tad south of Ashland and have a nephew who is a corrections officer there. There are two facilities at Ashland (it’s actually in Summit, KY), one a medium security with double fencing and triple strand razor/concertina wire at the top of each fence. The other is minimum security and that’s were Pete Rose spent most of his time if this old feller’s memory is correct.
The nephew says both are good facilities with excellent staff who are fair but also have a no Bravo Sierra attitude as far as managing the place and the inmate population. He says his approach is he expects to be treated respectfully and he will reciprocate. If he experiences the opposite then he reciprocates appropriately and all in his AoR know it. He says he’s had very little problems in his 11 yrs there. I always got the impression when talking to him that they run a pretty tight ship there.
I’d rather do time in a Fed facility than a state run place, any day!

When I migrated to Aussie (I call it Eunuchalia now) and it was in 1985, there were districts in Newcastle in NSW where the folks used not to lock up the door when leaving their homes.
Would you co-blame the ownes of the house for making it easier for the thief to steal their property?
Would you claim that the crime commited by the thief would be somehow milder and more acceptable and punishment applied less severe?
Palin used to live in community in her native Alaska among overwhelmingly honest folks, where the people indeed sometimes leave their doors open.
It didn’t even occur to her to make her own computer site more secure.
It doesn’t make that DEGENERATE less guilty.
He should consider himself BLOODY LUCKY.
If it was a litter of some Republican politician breaking to Biden’s computer site, that “kid” would for sure be accused of attempting to disrupt election and received at least five time more severe jail sentence.

I live 10 minutes from this prison….there are two….about a block apart.
We see them, in good weather, picking up trash on the highways, or grooming the prison grounds.
One of these prisons has barbed wire around it, the other doesn’t, so I expect he will be in this one.
This one is built right next to the National Guard building where they work on their trucks and heavy eq.
Come summer, maybe I will see him out picking up trash.
