Any passenger who refuse the new TSA gropings may face $11,000 fines and possible arrest.
The Sun-Sentinel reported, via Free Republic:

If you don’t want to pass through an airport scanner that allows security agents to see an image of your naked body or to undergo the alternative, a thorough manual search, you may have to find another way to travel this holiday season.

The Transportation Security Administration (TSA) is warning that any would-be commercial airline passenger who enters an airport checkpoint and then refuses to undergo the method of inspection designated by TSA will not be allowed to fly and also will not be permitted to simply leave the airport.

That person will have to remain on the premises to be questioned by the TSA and possibly by local law enforcement. Anyone refusing faces fines up to $11,000 and possible arrest.

“Once a person submits to the screening process, they can not just decide to leave that process,” says Sari Koshetz, regional TSA spokesperson, based in Miami.

Koshetz said such passengers would be questioned “until it is determined that they don’t pose a threat” to the public.

Palm Beach Sheriff’s Office spokesperson Teri Barbera said PBSO deputies stationed at the airport would become involved when requested by the TSA.

“We will handle each incident on a case-by-case basis,” she said.

No one will be forcibly searched or arrested “just because they refuse to go through the security procedures,” Barbera said. “That may rise to the level of suspicious behavior for the TSA, but it wouldn’t rise to the level of suspicious behavior for a deputy,” she said.

But Barbera said that if a person is judged to be a possible threat, deputies are legally permitted to detain and search that individual. “The deputies will do it at the airport just as they would do it anywhere else,” she said.

    The use of the scan and pat down has never been authorized by congress. The bill is still sitting on someone’s desk, not yet having been voted on.
    It was obama’s order to DHS – big sis – to use $1 billion of the stimulus to get the scans started. And now we have ‘gate-rape’.
    I have the feeling that obama is very much enjoying the humilation of the American citizens, who he has always hated, but especially after the election.

    Assaulting a Federal Officer Law & Legal Definition

    18 USCS § 111, makes it a Federal crime or offense for anyone to forcibly assault a Federal officer while the officer is engaged in the performance of his or her official duties. Purpose of this law is to protect both federal officers and federal functions. It was enacted both as counterpart to state law requiring increased punishment for assaulting peace officer as well as to provide federal forum for trial of offenses involving federal officers.

    As per the section whoever forcibly assaults, resists, opposes, impedes, intimidates, or interferes with any person designated as an officer or employee of the U.S. while engaged in or on account of the performance of official duties; or forcibly assaults or intimidates any person who formerly served as an officer or employee of the U.S. on account of the performance of official duties during such person’s term of service shall be guilty of the offense. If the acts amount only to simple assault, then s/he may be fined or imprisoned not more than one year, or both.     It is not necessary to show that the person knew the person being forcibly assaulted was, at that time, a Federal officer carrying out an official duty so long as it is established beyond a reasonable doubt that the victim was, in fact, a Federal officer acting in the course of his duty and that the person willfully committed a forcible assault upon him.

    So, punching that TSA agent could cost you $11,000 plus whatever fine for assaulting a Federal officer plus 8 years in jail.

  16. What are the qualifications for being a TSA agent? What kind of security background check is required? How often are background checks conducted on agents? I trust the backgrounds of the pilot and crew more than the backgrounds of TSA agents.

    On a similar note, remember that it was passengers, not TSA, that stopped:
    1. underwear bomber
    2. 9/11 UA flight over PA
    3. Shoe bomber
    4. every crazy person trying to storm the cockpit or open the airplane door in flight.

    It always been passengers, not TSA providing the actual security. How do we get paid for what we do, instead of fined?

    You should read some of the comments at Free Republic. TSA is really digging. Threatening to “question people until they are satisfied they aren’t a threat?” Does that include locking them up with no recourse under the Patriot Act?

    Employment Requirements
    Applicants must be a citizen of the United States or a U.S National and have a high school diploma, GED or recognized equivalent. If you do not possess the education component, you can still apply if you have at least one year of full time experience working as an X-ray technician, aviation screener or security officer. In addition to these two basic requirements, applicants will be required to meet the following employment conditions:

    * Demonstrate physical fitness to work on a daily basis without the aid of medication.
    * Work irregular hours and shifts, including holidays and weekends.
    * Pass drug and alcohol screening tests.
    * Pass background, criminal and credit checks.

    Thompson and Jackson Lee criticize the agency in their letter. They say TSA should have done a better job of informing the public about the new screening procedures while also making sure to better protect their civil rights.

    “Before implementing this new more invasive pat down procedure, as a preliminary matter, TSA should have had a conversation with the American public about the need for these changes. Even before that conversation, TSA should have endeavored to ensure that these changes did not run afoul of privacy and civil liberties,” they write.

    Read that first bit again – the lawmakers were briefed on these new procedures IN SEPTEMBER and expressed concerns then.

Fox republished this story, and the fact that everyone here is blaming Obama for something he VETOED is pretty laughable. Couple that with the fact that the right wing pundits like Rush Limbaugh are saying things like “your rights mean nothing if you are dead.” and you dont see any “conservative” politicians fighting against these machines even though they are ALL “strict constitutionalists” and these tactics violate the 4th amendment and the Supreme Court’s rulings that we all have the right to privacy (both things that the Patriot Act blew up and paved over, thank you Bush and Obama for continuing). The right wing politicians are not fighting this, and the president has no way of making laws, just signing them. He vetoed the DHS request for them so the TSA instead took its stimulis and did it anyway. But they dont. They like making you live in fear. Because if you are afraid, you will vote for them if they even sound like they can protect you. And its all BS.

Sweden has scanners that DO NOT show real human images but instead point to the offending object on a mannequin figure on the screen. And the scanners here wont pick up the materials that the “underwear bomber” used in his incident. The Swedish ones can, without showing anyone your naughty bits. This needs to stop and stop NOW! And the only way we can is if we put our petty disagreements aside and work together on this. And I will tell you what: Ive seen so called “progressives” defend this, saying it is Obama trying to make us safe and he wouldn’t hurt us. They are just as brainless as they claim you all to be.   70. President Obama has shown a true commitment to fine and punish the American people at every opportunity. If we don’t purchase health care insurance, we will be fined. If we didn’t answer all of the questions on the census form, we were subject to fines or punishement. Many travelers don’t know anything about the new screening requirements. If they get in line and don’t want to be exposed to radiation, their only choice will be the invasive body check. How are we to know that the TSA individual isn’t just a pervert. What about people who have a history of sexual abuse? They would be completely traumatized by this type of search. So, why can’t they just leave the airport without further interrogation by the TSA thugs? If the government isn’t informing every individual in the country of the new rules (not everyone watches the news because they are sick of Obama and what he is doing to the country), why penalize travelers who get to the airport ready to take off their shoes, follow the rules, only to find out that the rules have changed. They will now be exposed to unnecessary radiation and a complete invasion of their privacy. Why isn’t Obama thinking up new ways to stop illegals from entering our country instead of constantly coming up with new ways to penalize American citizens? Think about it. This is an easy way for the government to make money. If a traveler refuses the radiation exposure and cannot stand to be intimately touched by a complete stranger, the TSA agents can claim anything they want about that individual just to collect the $11,000. The traveler wouldn’t stand a chance against the government. This is what our country is coming to; and it is going to get worse because Obama will do anything to insure his win in 2012.

The american people are a bunch of sheep who deserve this treatment because they allow it. when will you resist? When will we take our country back? When we are in concentration camps? Don’t you sheep understand this is a test to see how far, we the people allow them to go?
