A San Diego man was arrested this weekend after he refused to complete the TSA screening process. The passenger was then paraded through the airport in his underwear.

Sam Wolanyk is a San Diego gun rights activist.
The Examiner reported:
In what can only be described as TSA handlers gone wild, the San Diego Harbor Police arrested an area resident for refusal to complete the screening/security process yesterday. This is the same airport that created the TSA security catch phrase “don’t touch my junk.” John Kliner of San Diego started the airport screening firestorm last week as Americans head into the busiest travel week of the year in the United States.
This time the defendant, Sam Wolanyk says he was asked to pass through the 3-D x-ray machine. When Wolanyk refused, Transportation Security Administration (TSA) personnel told him he would have to be patted down before he could pass through and board his airplane.
Wolanyk said he knew what was coming and took off his pants and shirt, leaving him in Calvin Klein bike undergarments.
“It was obvious that my underwear left nothing to the imagination,” he explained. “But that wasn’t enough for the TSA supervisor who was called to the scene and asked me to put my clothes on so I could be properly patted down.”
It was clear to Wolanyk that TSA only wanted him to submit to a pat-down and if they were interested in ensuring the safety of all passengers they would have rifled through his clothes, carryon baggage and acknowledged that he was not carrying any illegal paraphernalia on his person.
Once Harbor Police arrested Wolanyk, he was handcuffed and paraded through two separate airport terminals in his underwear to the Harbor Police office located inside a different terminal at the airport than Wolanyk had originally gone through during his TSA security process.
Another woman was arrested for filming the TSA screening process.

In some states it is illegal. Three states have passed specific laws that prohibit citizens from filming the police at work. A call for deliberate civil disobedience if I ever saw one. The remainder of the states are relying on the wiretap laws that make it illegal to record a conversation without the knowledge/consent of both parties.

After reading through so many incidents this week regarding TSA, here’s a question for the legal folks. Is it a violation for TSA to disclose private medical information? There are medical privacy laws with stiff fines for “failure to protect information.” Take for example a woman who is a cancer survivor and has a fake breast. This data would be protected in her medical records. If the data was leaked then the “leaker” would be fined under current law. If the TSA is essentially stripping people down to obtain their medical facts then are they not now handling private medical information? Is it a stretch? Suppose you have a medical condition and you’re about to fly. What if you prepare a written statement inside a envelope describing your medical condition. On the outside of the envelope it would be marked “Private Medical Information. Handle according to the Medical Privacy Laws–”cite the legal code sections.”" Then you obtain the name of the TSA agent and ID number of person or people you’re giving it to. That is one issue. I am also concerned about the possible contamination of that elderly gentleman who was left soaked in his own urine. (thread here yesterday) There is a huge risk that they introduced MRSA when they (seemingly deliberately) ripped his catheter bag away from the seal.
I am also concerned about the operation of those scanners. State and Federal laws in every state in the country require specific education (minimum two years), training, certification and licensure to operate any kind of X-ray machine used on humans. The TSA does not. The machines have not been properly tested and there is great concern about them in the medical community. Not to mention that no law allowing their use at all has been passed. It is still tied up in Congress!

You need to remember that low paid as these thugs are, they are still Federal Officers in the same way that an FBI Agent is. You are taking your life in your hand if you touch one, assault one verbally or – heaven forbid – contact one at home, which would instantly be interpreted as a threat.
If you assault one verbally you are going to spend a year in jail. TOUCH one and you will spend the next eight years of your life there. Don’t know off the top of my head what the penalty for making terroristic threats to a Federal Officer is, but I suspect that it would be just shy of Gitmo.

Someone with legal expertise needs to research the violations to individuals who are covered by the Americans with Disabilities Act (ADA). Another issue which appears to be blatantly in violation is the unreasonable search of portions of the population without any suspicion of threat (much less a reasonable suspicion). An example would be a police roadblock searching for a foreign terrorists enroute to Atlanta from the San Diego border with Mexico. There would be no reasonable cause to strip search two little old ladies traveling from Seattle to Portland in order to justify doing so in order to protect Atlanta residents from the risks of the dangerous drug lords. These reports of tragic violations all over the country are extremely distressing. Imagine if Elizabeth Smartt, God bless her soul, just happened to be #10 through the security line. Don’t we still have some reasonable expectation of privacy?? Or what if #10 were an elderly man wheelchair bound and with a pacemaker who could not pass through the scanner? Must he, by default, submit to the strip search because he has a pacemaker?

Well I have news for them GOD is watching and we are already starting to pray. Let me remind everybody several months ago there were 33 miners in a Chilean mine 700 meters (not feet but meters) a rescue like that was unique never done before. Well a lot of people in Chile and around the world started to pray and they came out all alive. The head of the operations André Sougarret was interviewed after the rescue and he did mentioned how the drilling equipment took and unexplainable turn that made it hit the mine tunnel right in the middle.
Evil forces always start making their move around special dates like Thanksgivings and Christmas. They are so predictable. They usually target old and disable people, women and children. I saw in the internet people in wheelchair getting pad-downed, I saw in the internet a lady with a prosthetic leg asking her to remove her leg. The scan machines are not suitable for disable people, they do not meet the standard (one more reason to make them illegal, I think they target disable people because they probably have a special place in havens and they are envious of them.
The Chilean rescuers did not just pray they took action and work day and night until they got them all out, with a little help redirecting the drill; we need to do the same. We are lucky, my wife has a titanium hip she will be a perfect target and we will not travel to see our daughter and grandson, but they decided to drive down and stay with us for a week.
But if you read this comment and you see an old couple that will be lonely during thanksgivings invite them over that day, you can always add some extra plates at the family table.

The Airline business has a broken model where they let a fascist government take over part of their operations (security) now they will pay the consequences. Take our family as reference; we are not going to accept radiation and nude picture taking of our members nor sick PAD-DOWNS. The current procedures targets disable persons for sexual harassment my wife has a titanium hip. So the whole family is not flying any more. Members of the family are now buying motor homes, new cars, etc. We are re-adjusting our recreation activities. Even if they fix this mess in the future, the monies for flying are not there anymore the money went into buying new cars (we just bought new car yesterday cash) and motor homes.
If you own airline stock sell them as soon as you can, there is no future in a business like that.
The airlines knew that the TSA was going to implement those machines and start humiliating your customers and you did nothing about it. Where your lobbyists in Washington are, fire them all, you needed someone at the helm of the TSA that understands the airline business. But you accepted the current administration of the TSA and you are now going to suffer the consequences.

I think everyone should be screened before getting on a plane. I don’t think I should sacrifice my presumption of safety because someone else is Muslim or because they think they are above being scanned or patted down. I think the way the TSA has handled the introduction of the new processes has been very poorly done but I think new procedures are necessary. Freedom makes this country great and I don’t want the government to have any more control than they should(and they have their hands in too much definitely). But why shouldn’t every honest American citizen want to make sure that the guy/gal behind them in line at the airport isn’t smuggling explosives or weapons. Shouldn’t we all stand together and say “we are going to root the evil out, we will find you and we will dispose of you because you cannot destroy us and our country”. The government wants this to turn into a media nightmare so the average American citizen looks stupid and belligerent and out of control.

Just a reminder, Bush created the TSA. Congress voted down these machines, the TSA bought them anyways. The man who made the purchase order now works for the company that makes the machines.
I’m really not clear on how this is Obama’s fault. I get that people are angry, but unless we start placing the blame where it actually belongs, that is directly on the TSA, we are missing the point.
