This is insanity.
The Ninth Circuit Court of Appeals threw out Arizona’s requirement that people show proof of citizenship today. The law has been on the books since 2004.
AZStarNet reported:
The Ninth Circuit Court of Appeals has overturned Arizona’s requirement that people show proof of citizenship to register to vote.
The split decision by a three-judge panel determined that the requirement to show proof of citizenship — passed by voters in 2004 — is not consistent with the National Voter Registration Act.
Associate Justice Sandra Day O’Connor, temporarily sitting by designation, and Circuit Judge Sandra Ikuta, with chief judge Alex Kozinski dissenting, said Prop. 200 creates an additional hurdle, while the national act is intended to reduce “state-imposed obstacles” to registration.
The majority noted that Congress was well aware of the problem of voter fraud when it passed the voter act, and built in sufficient protections, including applying perjury penalties to applicants who lie about their eligibilty.

Well in that case, require proof of citizenship to acquire or renew a driver’s license and a current in-state driver’s license to either vote or purchase alcohol.

I’m guessing thats what Calderon and Hussain wanted them to do.
Thank God , the loons of 9th circus suddenly found their collective spine and spoke truth to power.

Interesting how much clout the retired judges/justices have in our society, isn’t it?

Then why do I have to prove who I am to get on a plane? Why can’t they just apply a “purjury penalty” if I lie?

Ohio #4. That moment has already passed. I constantly point on that in my post to my American friends.
The solution: The “Pinochet” option. This is apt for today.
Tomorrow the only option that will remain shall be “Franco” option.
The same concerns my own Eunuchalia.
However, nothing is going to happen here untill the real changes take place in the US.
Only then our footy-apes will follow.
Unfortunately, we don’t have our own Sarah Palin, Allen West, Michelle Bachmann, Rush Limbaugh, Mark Levin and so may other equally fantastic folks that you have

Does that mean my neighbor who is Canadian and comes to visit here in SW Florida for about 4 to 5 months in in the winter can register to vote if he has a US drivers licence? He owns a beautiful house and is here by the middle of October each year. And he is a conservative.
Is there anything that could stop him?
Two can play at this game.

So glad I tore up my DD214 when I did. I am no longer proud of this country and no longer admit to anyone (or acknowledge on a job application for that matter) that I served. Why should I? What good did sacfrificing 8 years of my life accomplish?
A consitutional convention or dismantling of these United States (United…yea, ok.) similar to that of the old U.S.S.R. is in order. What path should we take?

Your kidding right?? O’Connor is a supreme court justice this ruling is by the 9th circus court of appeals. THE most liberal AND the most overturned court in the land 90%.

Then the next Congress had better change the National Voter Registration Act. After all, i must show I.D. to board a plane, cash a check, buy alcohol, and many less important acts than voting.

OK 9th circuit, lets apply your logic to another right shall we, I find it a “state-imposed obstacle” to be required to show a photo ID when ever I purchase a firearm. I believe that you just set a precedent.

The one thing he counts on is Americans to continue to turn the other cheek. It is fast approaching the point where such behavior is suicidal. There will be no day in court to address your grievances. If they are so quick to steal our votes, stealing your future is a cakewalk.

Due to the Patriot Act, in order to open a checking account at a Bank, you have to prove who you are – giving your name, address, social security number, date of birth, and provide legal photo ID. (I know this – I open accounts at a Bank). The Bank then runs that information thru a data base.
But you don’t have to prove who you are to vote? Weird.
arnonerik commented:
Our Declaration of Independence states that, “Governments are instituted among men, deriving their just powers from the consent of the Governed”. Decisions like these are pushing me to persue the next step outlined in the Declaration of Independence which is to alter or abolish the government. Our Government is out of control and I don’t know which of the three branches has gone astray more. The so-called remedies provided by congress are all after the fact, that is after the election. In practice, the fraudulent election results are never voided out changing the results of the bogus election. There is little satisfaction if the candidate, who should have won and could have won, is still the loser because of fraudulent votes. The Government has made cheating too easy and penalties either waived or minimized. The Party behind this is usually the Democrats and always the Liberals. I am sick of seeing our legal votes being diluted by cheats and frauds.
Ben in Virginia commented:
A threat of perjury prosecution is hardly enough to keep people from cheating especially when outfits like SEIU are padding the voter rolls with massive drives and hosts of obviously unqualified persons. There needs to be another level of verification to prevent voter fraud. The Voting Rights Act was a great idea but it is antiquated in the face of the massive fraud and abuse that is occurring today.
After all, when you open a bank account, you have to get verified via OFAC SAC to ensure you are who you say you are, and that you aren’t some sort of terrorist that is sending money to terrorists.
Shouldn’t voters be vetted at least as well as that???
Greg commented:
The only problem with the fraud penality being a sufficient deterent, is that to charge with a crime and have a court find fraud exists, ……your have to prove the idenity of the person being tried……. gottcha

That’s a very serious charge. I can’t think of a single instance where it is not supported, however. Which is an astounding realization, actually.
Thank you for pointing that out.
Let me testify of a state imposed obstacle to voting: My absentee ballot from California finally arrived today, with about four business days to make it back by unreliable post office. This is the way California (LA County) has handled my absentee ballot for the last seven years (at least): they wait until the last week to mail it to me.
To ensure that I get any reliable chance to vote, I choose to mail in the absentee ballot SAMPLE, which is usually mailed to me one month before election day, and is (reportedly) accepted.
However, that ballot sample only includes federal positions on the ballot, meaning that I am unable to (prevented from) voting on local races, or any of the initiatives.
If this is intentional (how could a mailing schedule planned months in advance not be?), this is a ‘state imposed obstacle’ to my right to vote as a US citizen.
If this is how LA County schedules absentee ballot mailings for all their absentee voters, someone should go to jail.
Best regards, Peter Warner.

O’Connor has Senior status as a retired judge, which means she sits on some of these panels to help with the heavy caseload. It’s not uncommon.
What IS uncommon is that she has become active in the state and nearby states in a variety of political causes and has been appearing and speaking at rallies, etc. If a judge is going to do that, they really have no business hearing cases.
So, Madame Justice O’Connor, please make up your mind and do one or the other, but not both. In the immortal words of John Riggins, “Lighten up, Baby!”
