Ace of Spades nailed it.
The Obama Administration announced today that they would send 1,200 National Guard troops to the Mexican border. Ace said it was just cover for the Administration so that they could go after the Arizona immigration law. Ace was right. In fact, today’s announcement was just a diversion. Barack Obama knew before today’s troop announcement that his Justice Department would challenge Arizona’s immigration law. His ingrained radicalism is predictable.
Tonight, a team of radical Obama Justice Department attorneys recommended that the U.S. government challenge the Arizona state immigration law.
FOX News reported:
A team of Justice Department attorneys reviewing the new immigration law in Arizona has recommended that the U.S. government challenge the state law in federal court, but the recommendation faces an uncertain future and tough scrutiny from others in the Justice Department, sources with knowledge of the process tell Fox News.
Staff attorneys within the Justice Department recently sent higher-ups the recommendation. At the same time, the Justice Department’s Civil Division, which oversees the majority of immigration enforcement issues for the department, has drafted a “civil complaint” that would be filed in federal court in Arizona, sources said.
The draft complaint challenges the Arizona law as unconstitutional, saying it is illegal because it impedes federal law, according to the sources, who would not offer any more details about the draft complaint or the arguments made in it.
Two weeks ago, Attorney General Eric Holder told lawmakers such an issue was being considered by Justice Department lawyers reviewing the new law, which outlines and possibly broadens the authority of police to detain those suspected of being in the country illegally.
The Arizona immigration law reinforces this national immigration law that has been in effect for 70 years.
UPDATE: Greta Van Susteren wonders if Obama is stuck in high school:
Why didn’t President Obama tell the Republican Senators when he met with them and discussed the illegal immigration issue yesterday that he was sending 1200 troops? Why did he let them learn from the press right after the meeting? He could have and should have told them as they were discussing the issue. It seems so high school (unless he has a really good reason but I sure don’t know it.) This is an important issue. It is too important to play games or politics.

Holder knows damn well there’s nothing wrong with the law. The heavy breathing is stalling. Meanwhile he’s busy influencing public opinion, while Democrats and Open Borders advocates try to whip up hysteria, with deliberately provocative words like “racist.” They want to have the law repealed by force of mob, by terror, because they do not have legal grounds on which to contest it.
The highest law enforcer in the land is trying to undermine the legal process.

Of course Obama knew he was going to challenge AZ before he sent 1200 N. Guard troops. The question is: Did he or anyone in his admin read the AZ law before they decided to challenge it?

Great article regarding the additional guard troops on the border:
“Washington » A Utah congressman said Tuesday that President Barack Obama’s plan to send 1,200 troops to the U.S-Mexico border won’t make much difference if public land managers won’t allow enforcement in wilderness areas.
Rep. Rob Bishop, the ranking Republican on the Natural Resources subcommittee over national parks and public lands, said Obama’s aim may be more about beefing up his poll numbers than beefing up border security.
“It is not a problem of not having enough personnel down there. It’s not a problem of the Border Patrol not being able to do the job,” Bishop said. The problem as he sees it is the inability of the Border Patrol to access some areas in protected lands overseen by the Interior Department.
Bishop has made border security along America’s public lands a personal mission and spent time in the uninhabited areas in Arizona abutting Mexico earlier this year.
President George W. Bush also sent troops to the U.S-Mexico border — including a group from the Utah National Guard — in 2006 after calls from anti-illegal immigration groups to do more about escalating border crossings. That, Bishop says, “obviously didn’t solve the problem. We’re going to have to have something more than just a few bodies down there.”
Rep. Jason Chaffetz, R-Utah, said Obama’s move is a step in the right direction but he’d like to know why the president isn’t sending more troops.
“It’s about time they woke up and recognized there’s a massive problem there,” Chaffetz said.”
Now libs are trying to increase the Wilderness areas along the border in New Mexico which will increase the illegal immigration problem.

jonyjoe101 (#9) , you named them all except the biggest democrat voting bloc of all:
The unions.
These union members know they cannot keep hiding for much longer, from the destruction they are causing by electing democrats to power.
They are now seeing that the “social issues” that Republicans have been warning them about for years, are not “schemes” to divide America, in order to get Republicans elected.
Union members are seeing full well, in the sunlight now, what the Progressives like Nancy Pelosi and Barack Obama have been doing to destroy their children’s future. These “social” issues are the Progressive democrat’s religion.
The union members are being used, and they now know it. They are being used to fund the elections of the most sick, twisted, control-freaks to every grace the Whitehouse and Congress.
Until the hearts and minds of more union members come to realize how they are being had by the democrats, it will be hard to break the stronghold that these Progressives have on America.
I’m not saying that ALL union members are brainwashed. We all know there are thousands of union members out there who are conservatives in their midst, that don’t vote for these Progressive democrats. To those union members, I say hang in there.
I still believe that many corporations today would not treat workers justly, if it were not for unions. I also believe that most unions have become too powerful in their mandates. It should be illegal for unions to be involved in funding campaigns, and lobbying our government.
As a conservative, I will buck the trend of some of my like-minded friends, and say that I think it should be illegal for corporations to do the same things.
These types of activities should be at the INDIVIDUAL level. McCain Feingold was not the way to accomplish this.
I also believe the differences between unions and corporations have been made worse over the years, by the constant back-and-forth power grabs. The corporations take more, then the unions take more back. Now look at what has happened to our auto industry.
I think the Corporations and unions need to take a “disarmament” approach in the future.
In other words, instead of both sides trying to gain more power, both sides should go back to common sense.
Maybe more corporations could try offering decent pension plans again, and the unions could be willing to scale back some of their over-the-top wages and benefits. Wouldn’t this help both sides in the long run?
Things have gotten PROGRESSIVELY worse over the years. Sometimes progress gets ahead of itself, and I think that has happened in a lot of ways in the United States.
If it’s not broke, then don’t fix it.
Instead, we have been fooled into believing that constant progress (Progressivism) is what America needs.
Glenn Beck nailed it with Common Sense, just as Thomas Paine did.
We need to get back to common sense and stop trying to change things, in the name of “progress”, that are not broken.
I’m just trying to remind us all that there are solutions to our complaints, and soon enough, conservatives will in charge, and we will listen to the people, and have to make a lot of tough decisions for our future.

As a conservative, I am fine with unions having the mandate of:
providing workers with a reasonably safe work environment, a commensurate wage, and protections from being fired by bosses on a personal vendetta, against a worker they personally dislike. Being fired for being lazy, or breaking rules, or the company cannot afford the position any longer, is fair game.
How about we get back to a common sense mandate for unions, and stop the nonsense of letting them bankroll democrats?
How about we lower taxes to near zero, on businesses that provide real jobs to working Americans?
How about we outlaw these liberal non-profit groups like the Tides Foundation, that are nothing more than money laundering shell games, that Progressives use to hide who is bankrolling power brokers, who are destroying America?
How about we:
-Allow prayer to God back in our public institutions. Respect all religions, but teach students that the USA was founded on Judeo Christianity, and that our nation has a right to keep that tradition, like every other country has a right to keep their traditions. Rebuild the traditional American family unit.
-Remove progressive majorities from schools and universities, and correct revisionist history teach the truth about our founding fathers.
-Term limits for Congress.
-Serious control of our borders with a fence. Build a strong national defense. Fight wars reluctantly, but fight to win.
-End identifying race, except for crime, and security.
-End affirmative action. End speech codes at Universities. End race specific universities, and race specific broadcasting channels, and race specific clubs in school or work.
-Back to Constitutional limited government. Steadily repeal every progressive law possible.
-Severely limit our contact with world governing bodies like the UN and world economic commissions.
-Stop creating money out of thin air. Our current system of letting banks and the Fed create money out of thin air for credit, is not working anymore. Citizens and States need to have more control over how much money is produced, what its value is based on, and the fractional reserve rules and rates that regulate it.
-Stop basing our family law on British Common Law. Reform our court systems to end laws that favor one sex and race over the other.
Reform family law in order to give law abiding parents equal rights to raising their children. Treat fathers just as equal as mothers.
Create new power plants, of every viable type, for a comprehensive energy supply, for our future.
Protect our environment and forests in responsible ways, like replanting trees, conservation, recycling, and without destroying common sense jobs.
Cut the budgets in half, pass a flat tax of 15 percent.
Common sense.

What must one do today to protect and defend him/herself, family members, and property when the government is either incapable of doing so or is derelict in their constitutional duty.
In Arizona, the citizenry are under assault from individuals, thugs, who enter this country illegally. These “undocumented aliens” as the politically correct left prefers to call them, damage property and threaten the safety of law abiding citizens whose cries to Washington are met actions which are insufficient at best.
In response to what is seen as a lackluster response to their plight the legislature of the State of Arizona has passed a law to address what they see as political intransigence by the federal government. For this they are excoriated in the liberal media and accused of being “misguided” in their efforts to secure the safety of those they represent. But is what they are doing to protect their citizenry really so outrageous? Consider, please, the following true story.
The time: July 10, 1981. The place: the northwest Missouri town of Skidmore.
For the past twenty or so years the residents of Skidmore, Missouri lived in fear of Kenneth Rex McElroy. In his best selling book “In Broad Daylight” author Harry N. Maclean details the background of Skidmore’s “town bully.” McElroy robbed, cattle-rustled, raped, burned and assaulted almost at will. Local cops were scared of him. The law couldn’t convict McElroy because no one would testify against him. Twenty-two indictments were brought against him he was never convicted. Intimidation of witnesses was his best defense – and it worked.
Like the citizens of Arizona, government that should have been able to protect the citizens of Skidmore failed. Finally, the townsfolk had had enough.
On that hot July day a group of townsfolk decided to take action to do what the government failed to do to protect the residents of their town. So, when McElroy and his wife left a local bar and entered their pickup truck a group of 45 men surrounded them. Shots were fired and the town bully was no more. Then the crowd dispersed.
Suddenly, law enforcement, including the FBI, was all over Skidmore seeking to discover who had killed McElroy. But nobody saw a thing. And to this day no one is talking. Was this a case of justice finally being achieved or were those who shot McElroy misguided? Given the circumstances what would you have done? And if you knew who had pulled the trigger that day would you have told law enforcement officials who they are?
I bring this up in light of the brouhaha over the newly enacted legislation in Arizona which authorizes local and state law enforcement to do that which the federal government is either incapable or too incompetent to do.
Those in Arizona who are most affected by the influx of illegal aliens who are perpetrating crimes are applauding their state legislators. On the other hand, you have politicians like President Obama calling the legislation “misguided.” Ditto the Liberal media including those misguided souls on the editorial board of the St. Louis Post Dispatch whose members are more interested in the constitutional rights of criminals than the safety and security of law-abiding citizens of this country.
And if this isn’t enough we have Felipe de Jesus Calderon Hinojosa, the president of Mexico, a country rife with crime and political corruption railing against those in Arizona who want to arrest citizens of his country who have broken the law seeing as how they are in this country illegally.
Calderon’s cries of outrage are a joke in light of a recent Associated Press Story in which Amnesty International cited the abuse of migrants in Mexico. According to the AP, Amnesty International has charged some government officials with having turned a blind eye or even participated in the kidnapping, rape and murder of migrants from Central America who are heading to the U.S. Furthermore, this despicable conduct has been acknowledged by the U.S. Interior Department.
Hey amigo, anyone with a modicum of common sense upon hearing your criticism of Arizona would have to conclude what you have said is either a bad joke or that you are muy loco!
Considering the record, was the action of the townsfolk of Skidmore misguided when they took responsibility for protecting their citizens when for twenty years government failed to do so?
Or was the action taken by the Arizona legislature’s passing of a law to help protect its citizens when the federal government failed to do so, misguided? Or were both justified in doing what they did when their political leadership failed to exercise their constitutional duty to do so?
I know how I see it, how about you?

Well, the administration has a tough row to how to prove the law unconstitutional. Recent court decisions and a little matter of the US Code.
From the concurring opinion of the Chief Justice of the 1st Circuit Court of Appeals:
In my view, the specific facts of this case also require the conclusion that the officer is entitled to immunity on all claims related to the detention and escorting of the vehicle and its passengers to the immigration authorities. Officer Chabot had more information at his disposal than merely the Hispanic appearance of the passengers and their inability to speak English. He knew from the driver that all plaintiffs were on their way to work. He also knew that when asked for some form of identification, most plaintiffs produced none, two offered Guatemalan consular identification cards, and one a Sports Fitness club I.D. card with no birth date on it. None of the passengers produced proof of United States citizenship when asked, nor did anyone produce a green card.
This information raised the real prospect that there were violations of criminal law by the driver, 8 U.S.C. § 1324(a)(1) (A)(ii), possibly by the employer, id. § 1324(a)(3)(A), and by the van’s passengers, id. §§ 1304(e), 1306(a). Employers are required to review documents from the individuals they employ. Id. § 1324a(b)(1)(A)-(D). These materials include both employment authorization and identity documentation, id., such as a resident alien card or an alien registration card, id. § 1324a(b)(1)(B)(ii). Accordingly, if the passengers were employed as they said, they likely would have had, at a minimum, some form of identity documents. If they were not American citizens, a reasonable officer had grounds to believe they were violating the requirement to carry their registration, id. § 1304(e), or lacked registration because they had entered illegally, id. § 1306(a). Either situation was a violation of law.
Thus, there was a reasonable basis for the officer to contact Immigration and Customs Enforcement (ICE). The ICE representative called back three minutes later and noted that the agency wanted to identify the passengers and their status, “due to the lack of identification and strong possibility that the [van's] occupants were illegal immigrants.”
This was enough to raise a serious question, warranting further investigation of whether plaintiffs were in violation of immigration laws. A reasonable officer would believe this evidence was sufficient to merit extending the period of detention for the next one-to-two hours to accompany the van to the ICE office, whether the passengers consented or not. Indeed, federal law gives the authority to arrest for violations of § 1324 to all “officers whose duty it is to enforce criminal laws.” Id. § 1324(c).
Plaintiffs’ claims were properly dismissed.
From 8 USC 1226 (d)
