Oh Brother… After his bumbling interview yesterday with Adam Sharp where he said he “doesn’t worry about the Constitution”, today Rep. Phil Hare (D-IL) released this YouTube video where he lectured bloggers on the US Constitution.

At least, he didn’t quote the Declaration of Independence this time:

    Why is it, that in the video of the person at the TEA Party in Washington two weeks ago getting some spittle on a Congressman while he was yelling wasn’t “taken out of context”? It was immediate, and continues to be, completely blown out of context as a deliberate, malicious act – when it obviously wasn’t.

    Another Democrat Congressman asks a Navy Admiral, during a Congressional hearing, if he is concerned that Guam will “tip over and capsize” if too many people populate it. The next day, he also release a statement that his words were “taken out of context”

    Even when cought on camera, these people have the audacity to continue to tell us we’re too stupid to understand what they said, when we just heard what they said and how they said it from their own mouths.

    The argument now is, “Who are you going to believe? Me or my own lying mouth?”

    1) He actually said he didn’t *worry* about the Constitution (not he didn’t *care* about the Constitution),

    2) Pointing this out this error will not generate much approval in this community, and

    3) Defending the truth of what Rep. Hare said is not the same as promoting Rep. Hare’s point of view.

    Like many here, I disagree strongly with the man’s views. Like yourself, I think we should be honest in presenting our argument.

  54. Is this what the classy Congressman is wearing in the House today? Some people are born great and some people have greatness thrust upon them and then there is John Wayne Gacy Hare who can’t even spell great.

  55. If one were to read the words Rep. Hare spoke above written out, it would come across as a reasonable effort to communicate his view and patch over hurt feelings. He says ‘I’m sorry’ and ‘thank you for your time’, he mentions his military service and dedication.

    Military service is a serious plus, regardless of the man’s current position. He signed a contract that included giving up his life if need be, willingly. That should earn our respect and appreciation.

    Watching the video that comes with his words, however, gives a different message. He speaks haltingly, reading from prepared sentences, and seems very uncomfortable. He keeps fidgeting with his left hand, arranging his left hand middle finger to a position of solitary prominence, then folding it under, then back out again.

    His words read well, his body language says he doesn’t mean them. That’s my interpretation.

    As a general concept ever law is constitutional until a Court says otherwise. I take his statement as “since the Supreme Court hasn’t said this “proposed” law is unconstitutional it therefore isn’t.” There is no way to square that circle of thought.
    I am not sure exactly what his thought process is but since I’m conservative I probably never will.

    The main premise of your argument, based on the health care bill, is that there is NO enforcement. While we appreciate your attempt to spin the Democrats’s poor talking points, it avoids the offsetting of tax refunds and specifically the garnishment of wages set up by the IRS and the application of interest to unpaid tax amounts themselves as oppossed to interest on the penelaties. Nor do you address the enforcement procedures for not reporting your “health care” status to the IRS. What happens if I do not provide the proof they ask for- nothing ?

    You do know that the IRS can set up a payment plan, without your input, and take it from your wages? Legally, this is not a levy

    While I agree the section you point to in the bill does address liens on property and levys on the monies from such properties, it does not address all IRS enforcement abilities and as such, your statement that there is NO enforcement is wrong and misleading.

    Besides, I’m not sure this is as big a deal as the Democrats have been trying to make this out to be. The lien and levy enforcement provisions for failure to pay the penalty may have been exlcluded because they won’t be necessary. For example, if you don’t provide proof of insurance with the return, the IRS can simply compute the penalty as part of the tax on the return, apply your credits to the penalty first, and leave you with a reduced credit or ordinary tax due that is subject to the collection procedures. Thus, they are not collecting on the fine itself, per se, but the TOTAL remaining tax bill

    While my points may not be as powerful as your third party hearsay from “some IRS” people that you are doing “some work” for, they are valid and true and have made your statement of NO enforcement false. As such, Enjoy your underwear!

    Then again, you may believe that the an indiviudual will have a never ending tax “health” bill that will NEVER grow with interest; NEVER be exposed to tax credit offsets and be accurred year after year with no impact on their tax return and they will NEVER have to provide proof of insurance since there is no fear of ANY negative reprecussions.

    Of course, one suspects that you probably voted for Obama and as such, you still believe in unicorns and “hope and change”

More specifically, given the Constitution’s silence on public healthcare, the 10th A. automatically reserves government power to regulate healthcare to the states, not the Oval Office and Congress.

Jefferson’s clear explanation of the General Welfare and Commerce Clauses would have prevented decades of illegal federal government taxing and spending.

    Regarding Congressman Hare’s bleeding heart, Jefferson clearly indicated that good intentions are no substitute for enumerated powers when it comes to making legislation.

    Finally, here’s an excerpt from Jefferson’s writings on the Commerce Clause.

    “For the power given to Congress by the Constitution does not extend to the internal regulation of the commerce of a State, (that is to say of the commerce between citizen and citizen,) which remain exclusively with its own legislature; but to its external commerce only, that is to say, its commerce with another State, or with foreign nations, or with the Indian tribes.” –Jefferson’s Opinion on the Constitutionality of a National Bank : 1791 http://avalon.law.yale.edu/18th_century/bank-tj.asp

    With terms like “does not extend” and “exclusively,” Jefferson made it clear that Congress has no authority to interfere with intrastate commerce.
