White House Press Secretary Robert Gibbs told reporters yesterday that the Democrats will use the “Slaughter Rule” to pass other pieces of legislation, including immigration.

QUESTION: Thank you, Robert. Mark Levin with the Landmark Legal Foundation has prepared a suit against the President that if he signs the health care bill passed by the House without a recorded yea or nay vote required by Article I, Section 7 — my question on that is, would the President rule out signing future bills such as immigration reform or finance reform you mentioned earlier that are not subject to a yea or nay vote in both chambers?
MR. GIBBS: Again, this is — I think we’ve discussed on a number of occasions, certainly the last time we met inside, that this was — this is the type of thing that — the type of rule that you’ve seen pass on any number of instances. So I understand that there are those that want to discuss this as being a unique thing. It is not. I stated earlier that when this bill passes the House the President will be happy to sign it.
CNSNews spoke with conservative Mark Levin on this new Democratic maneuver to ram through their radical agenda:
Mark Levin, the president of the Landmark Legal Foundation, has noted that a lawsuit was brought in regards to a similar matter in the 1998 case of Clinton vs. City of New York, in which the U.S. Supreme Court found that the line-item veto was not constitutional.
That ruling cited the Constitution and stated that for a bill to become law it was neccary that “1) a bill containing its exact text was approved by a majority of the members of the House of Representatives; 2) the Senate approved precisely the same text; and 3) the text was signed into law by the president.”
Levin called the Slaughter Rule an “attempt to amend the Constitution without going through the process.”
“Gibbs’s incoherence is an attempt to deceive,” Levin told CNSNews.com on Thursday. “I have no doubt in my mind that the White House is working very closely with Pelosi and her lieutenants on this strategy of pretending they voted on an underlying bill when, in fact, they didn’t vote on it. So that’s why he is so deceitful.”
“His boss (Obama) yesterday, in an interview with Fox News and Brett Baier made quite clear that he’s well aware of what’s going on at the Hill and whatever comes to him, he’s going to sign,” said Levin. “So what we’ve learned from Brett Baier and you is that we have two branches of government that are absolutely committed to violating the Constitution in order to achieve an illegitimate ends.”

Every legislative bill for which the House has used a self-executing rule in the past has already been considered, debated, voted on, and passed by the House.
In all uses of a self-executing rule, the House has never “deemed” as passed a bill on which it has not yet voted, but rather uses “deem and pass” in order to expedite passage of the Conference Report for a bill that has passed both House and Senate.
Thus, in all such cases, the Congressional record will show the results of the consideration of the bill. What is being “deemed” is merely that bill, as amended in Conference.
The Slaughter rule is unprecedented.

@NC Cop: it’s not a done deal. Frau Pelosi doesn’t have the votes. If she did, it would already be on the floor of the House, being voted on.
The budget reconciliation bill may be a non-starter also, as House members know that a) it can’t be used to “fix” everything they oppose in the Senate bill (see: abortion funding), b) the Senate will never move on the bill, and c) their constituents will hold them accountable for passing the Senate bill.
So, don’t give up hope yet.

I almost want the House to try this, just so that it can get run up to SCOTUS sooner, rather than later – so that the Tyrranical Triumverate can get put back in their place as soon as possible.
These antics are rather quickly rising to the degree of dereliction of duty, if not outright subversion of the Constitution.
If Obama signs a bill that has not been passed by the House, then right after Boehner assumes the Speakership next January, the House should commence immediately on the drafting of Articles of Impeachment against both the President and the deposed Speaker Pelosi. (Reid will – thankfully – be looking for a cushy K Street job by then, so no need to worry about him.)

They don’t have the votes.
None of the whip counts have them even close. At best, they are 12 votes away. At worst, they are twice that far away.
The most accurate counts I have seen have the “Yeas” at 204, the “Nays” at 211, and the “undecideds” at about 16.
All 16 “undecideds” are from heavily conservative districts, and are definitely leaners toward “Nay” votes.
Also, as far as I can tell, aside from Stupak himself, none of these whip counts are really tallying the Stupak block as probable “Nay” votes, due to the abortion launguage.
From the vote in November (not counting members no longer in the House), Pelosi has gained 2 confirmed Nay-to-Yea switches, and has lost at least TEN Yea-to-Nay switches.
The momentum is not in her favor, and she knows it. That’s why the bill has yet to come to the floor of the House.

We, on the right, were not vigilant. We allowed this to happen. Most of us may not deserve it, but we all have a responsibility as citizens. I take my blame. I didn’t think elections mattered. I thought the 2 candidates were so similar there was no difference.

Chip, when Krauthammer says he thinks it will pass, it probably is going to pass. And then the fireworks start. Idaho has passed a law that this abomination cannot be forced on their citizens. VA and 30+ other states are lining up to sue. The SCOTUS could stop this whole thing pretty easily.

In effect, we turn Cloward-Piven back on them….overwhelm the federal law enforcement structure with complete noncompliance. I can only imagine the utter chaos in this country if it were a republican president and congress operating this way. There would be complete anarchy with literal rioting in the streets. I don’t ever want to hear another fool-ass democrat refer to President Bush or any other republican president as an imperialist or fascist. This is unreal! But it’s worse than that. I’m seriously concerned that if this M/O is not stopped immediately and it continues on, the consequences could be disastrous. I’m not talking about disastrous for democrats in the upcoming election either. I’m seriously worried that something terrible may happen, even to the President. I know how this whole thing has affected me causing near panic at times. But it’s not me any of them have to worry about. There are however people in our society (and you know they’re out there) who would consider it (or heaven forbid may already have considered it) a God-given assignment “for the good of the country” to do something drastic. Does anyone else share that fear? I seriously pray to God nothing like that happens.
