Today on FOX News Sunday Rep. Chris Van Hollen announced that Democrats will use the “Slaughter Rule” to ram Obamacare through Congress. GOP House Whip Eric Cantor tells Van Hollen it’s unconstitutional.
He’s right:

  1. I don’t think there’s ANY question that the Slaughter Rule is a clear cut attempt to do an end-around on the INTENT of congressional responsibility as was so carefully crafted by the framers and, therefore, would be struck down as un-Constitutional.

    This isn’t a minor rule change; it’s an extremely drastic – and pretty stupid – move. I would expect a unanimous SCOTUS decision, which would effectively destroy the entire legislation.

  3. Well a simpler way that doesn’t involve all the messy “Consent of the Governed” crap is just let Obama-Chavez write down what he wants to force America and sign it.

    As the British found out, that doesn’t work so well with armed people.

  4. I’m trying to put the best spin on this weird rule. It could be there to provide cover for when this legislation goes down in flames. Dem reps who want to vote ‘no’ but know that it would alienate the liberal base can say “Well I wanted to vote in favor of the bill, but I couldn’t vote for this CRAZY rule!!” At the same time, those who want to vote “yes” for the bill but who know it would be political suicide in conservative districts can say, “Well, I couldn’t vote for that crazy rule!”

    If the House of Representatives acquiesces to the health care bill passed by the US Senate, they do so in violation of Article 1, Section 7 of the United States Constitution.
    Article 1, Sec. 7 states:
    “All bills that call for the raising of Revenues MUST originate in the House of Representatives.”

    The legislative canard that each House of Congress can determine its own rules sidesteps the very plain language of the Constitution, itself.
    Although the House of Representatives has passed its own health care bill, that House bill is NOT what it is going to be acted upon. Rather, the House will be acting on the health care bill that ORIGINATED in the Senate. It will be as if the House version does not and never did exist.
    In absence of some conference committee agreement or other procedure that would amend the House Bill and then be put to a vote of both House and Senate, any action in the House of Representatives that would allow the Senate bill to become Law, is clearly unconstitutional.

    Even the dumbest of ‘Constitutional law professors’ would get this…I would think this issue would be widely discussed and debated by now. Yet, I’ve heard or seen little or no analysis (except Eric Cantor this morning) from any media… Am I missing something here?

  8. If Health Care ‘reform’ gets passed via the Slaughter rule, I’d like to hear the GOP say they are going to bring the whole thing before the Supreme Court and have it tossed out. If this has to wait to happen until after the GOP regains the House and/or Senate in 2010, so be it. It has to go down in flames! This is so unconstitutional.

  9. Mark my words, Obama would love to throw this to the Supreme Court. Dems would take credit for trying to reform healthcare but claim it was subverted by an overreaching ultraconservative SCOTUS. He already laid the ground work in his SOTU address to make them the bad guys any way it benefits him. He’d say it was necessary to re-elect him in 2012 so he could appoint people who would “uphold the will of the people.” And don’t think they wouldn’t bring up the 2000 election to add to the sentiment. It doesn’t matter that they’d be lying, all that matters is convincing enough people that they’re right.
