Change. Judge Throws Out Evidence Against Gitmo Detainee

Let the sideshow begin… A federal judge tossed out most of the evidence against Gitmo terrorist Musa’ab Omar Al Madhwani.
The AP reported:
A federal judge has tossed out most of the government’s evidence against a terrorism detainee on grounds his confessions were coerced, allegedly by U.S. forces, before he became a prisoner at Guantanamo Bay.
In a ruling this week, U.S. District Judge Thomas Hogan also said the government failed to establish that 23 statements the detainee made to interrogators at Guantanamo Bay were untainted by the earlier coerced statements made while he was held under harsh conditions in Afghanistan.
However, the judge said statements he made during two military administrative hearings at the U.S. detention center in Cuba, where he was assisted by a personal representative, were reliable and sufficient to justify holding the detainee.
Musa’ab Omar Al Madhwani allegedly engaged in a 2 1/2-hour firefight with Pakistani authorities before his capture in a Karachi apartment in 2002.
JWF says this on today’s decision: “This ruling, of course, will now be used by future defense attorneys to get even more evidence against their clients thrown out.”

It was said that Obama decision to hold a trial in New York of the confessed mastermind of 9/11, Khalid Sheikh Muhammad, and the rest of the Guantanamo detainees, is proof of the US’s just legal system. But the Muslim world already knows that. Not one Muslim country demanded such a trial or claimed the KSM was innocent. To the contrary, the Muslim public, in general, think that Americans are stupid for opening their country to such terrorists and giving visas to terrorists while often denying it to legitimate travelers. Recently, my daughter innocently asked, why is America trying to tame untamable terrorists, it is like “having a pet shark”.

Ah, another Friday night and another surprise! A federal judge tossed out all of the evidence against my brother Musa’ab Omar Al Madhwani – and deservedly so. He only had one or two shoot-outs with Pakistani troops. He should be given at least three strikes. This shows our legal system works.
And, this should be a swift kick the crotch of our Troops. I hope they have learned their lesson. Don’t join the military because we are not at war. There are just legal cases involving man-made disasters.
Remember, Muslims invented everything from the pen to the printing press. Americans did not invent anything. They sukk and so does their country.
My limousine is running and I have a meeting with Bill Ayers. I think we can find brother Musa’ab Omar Al Madhwani a teaching position at a Chicago University. I must look busy. Good Afternoon.

To be fair, the judge has no choice.
When you put a military combatant in a criminal court, the judge has no choice but to apply criminal law.
This will only be the first of many problems brought about by the administration.

Oh the judge had a choice. He could of said, “wtf is this case doing in-front of me! This case has no business being held here! Send this case back to military where it belongs. Are you prosecutors really this stupid! Are you all a bunch of socialist wack jobs trying to subject my country to this threat! Are you all insane! And that, boys and girls, is soooo obviously the plan. With all of the attorneys nestled in Congress, one would think that someone just might be aware of the fact that this ain’t gonna work!
It’s a political stunt, pure and simple – an extremely expensive one that WE will pay for and one in which the chances of getting a conviction are nil. The chances of shining a very negative light on the Bush administration are 100%.

I said to a family member last night, that I never would have thought in an advanced country like America, we would have such stupid, head in sand officials. I want to cry for this country, and the citizens, because we have no control, and the people that do, just sit back and watch this foreigner Obama, and his henchmen tear the country from limb to limb. Damn all of you who could stop this and don’t. Someday, when the country has been destroyed you will ask yourselves, why did I let this one man do this? I’m sure many asked the same thing when Hitler was history. Can’t you for once get past this mans skin color, I don’t give a damn what his skin color is, it is pc that is keeping you from stopping him. The muslim sympathizer in chief has set the tone. He has declared we are kinder , fairer, and in effect are willing to give even deluded terrorists the pass they so richly do not deserve.
